Re: UK residence card refused!

I was detained in one of those routine visits at the reporting centre but the judge released me on the grounds that I have a valid marriage with a UK citizen. My lawyer sent a further submission to the HO straight away and my husband is also suing the HO. I would say, stick with the appeal under ...

Re: Free movement rights guide

The appeal is listed for March next year. We have to wait a total of 8 months which is ridiculous since the Mrs is already in the UK. When is your appeal and what were the reasons for refusal? Appeal is listed in march. reasons for refusal: not enough proof for self-employment. short stay about 4 ...

Re: Free movement rights guide

The current guidance just as much implements Akrich even though there is no mention of the judgment. if one of the reasons for moving to another Member State was to avoid the requirements of the Immigration Rules but the residence in that Member State was in any case genuine (see stage 3), then the ...

Re: pending EEA appeal leads to overstaying?

A pending appeal is supposed to be treated as though you have a pending application. On the EEA route, residence cards do not grant any rights but confirms them only. What if the appeal is refused. Lets say in SS route. Will the period then be considered as overstay if you want to apply for any ...

It depends on the relationship with the EU sponsor. If married, then no.

What if it is a direct family member ( +21 dependent of BC (ss route)) and the sponsor is still exercising treaty rights while the appeal is pending?

pending EEA appeal leads to overstaying?

Hello members, Wonder if you can share light on this? Anyone who have got EEA residence card refusal can be removed? Does it means that the applicant is considered to be an overstayer even his EEA appeal is pending? So if the applicant decides to apply for entry clearance from the home country under ...

Re: Eea4 Surinder Singh and full time carer

For the purpose of people relying under Article 21 of the Treaty to return home, it will be necessary for them to show that they are continuing to work or self sufficient upon their return. However people who rely under Article 48 may not have to show that, in light of EInd. Obie , please may I ...

Re: Eea4 Surinder Singh and full time carer

Under SS, there is no need for you to have worked according to Eind case law. No-one on this forum, on any government web site, or anywhere in the public domain can prove that Eind law has been overturned. Therefore it still applies. What the UK government is trying to do since 25 November 2016, is ...

Re: visa revoked few days after it was given

Why dont you go to the same premium service centre and perhaps have a chat with them. You can request to speak to someone senior there(like senior caseworker or maybe someone at the top) and argue your case. To the least you can argue about refunding your fees and right of appeal.

Re: Uk-EU joint technical note Interpretation

I believe Surinder Singh would be covered under Article 21(1) TFEU. When a British Citizen exercises his or her Treaty rights and returns to the Member State of his origin, Article 21(1) TFEU confers on their non-EEA national family members a derived right of residence. EU citizens resident in ...

Hello, So my husband's appeal went to court on Friday 22nd. When we got to the court, his case was first to be heard and the HO Presenting Officer withdrew the case. The judge explained that there was no longer a decision for us to appeal against so the appeal would not be heard. What happens now ...

For British Nationality, if you disclose the entire details of the incident along with the proof of how you were unlucky at that time. Then it might go in your favour.
