Ok thanks for the confirmation, he is keeping this application and hopefully he can get it asap. How do we pay for IHS etc in this application as this was done for ILR as I remember he didn't pay for IHS?

Ok thanks, his visa is expiring on 23rd Nov so withdrawing and resubmission tier 2 dependant will be after this date will that an issue ?

Also tier 2 dependant has super priority?

He didn't apply in 2021 because he had visa extension which was expiring in Nov 23.

In 2022 - he was away from 3rd Dec'21 till 14th Jan 22

And 7th July to 28th Dec that might cause over 6 months rule ?

I got my British citizenship via tier 2 (general) 5 years to ILR so I don't think 10 years will apply to him ?

thanks for your reply and so overstayer can impact her MN1 application as well?

We got her Tier 2 (dependant) visa in March 2020 and we received it until 10th Oct 2020 (when my Tier 2 was expiring). So we were under an impression that after my ILR we can directly apply for MN1.

ILR dependant for Kid while MN1 is in process

Hi,

We have to travel in April'21 and there is no sign of MN1 form (Sept 2020). Can we apply for ILR dependant for her while MN1 is still in process. As there is no timeline given on MN1 after 6 months we are thinking of doing ILR dependant.

Please guide us.

Sorry by ILR extension I meant Tier 2 general extension, she was on Tier 2 general extension which expired on 10th Oct 2020.

She was born before I got ILR.

A child born in the UK doesn't require ILR either (or a valid visa) if you plan on registering the child as British. So it means I should not apply for my child's ILR with me but wait for my ILR and register her as British citizen after ILR and go for my husbands Visa extension. Is my understanding ...

You don't need a new CoS for a dependent extension!! Dependents are not dependent in the employer. You simply apply for an extension on the pbs dependent form. It will be a 3 year extension. Thanks for your reply, as per your advice my understanding is:
If my visa issue date on BRP is 11-09-2015 then I can apply on 15-08-2020 or 14-08-2020?

I am a little confused :? to include visa issuing date or not in the calculation of 28 days.
