Until the divorce is finalised you can apply as spouse of a British citizen, apply straight after ILR and show 3 year evidence of residence. You have full custody with court papers for a minor child who is orphaned. I don't see any issues as you're now the minor child's legal guardian, so should be seen as your own child now.
