Can I make a Tier 2 application IF ILR refused

HI, I am on eligible for ILR in sept '2015. I want to know if my ILR gets refused(by chance) can i make an Incountry application for tier 2 general as my company wants to sponsor me as they are ready to apply for sponsorship certificate .
