Re: I have pre-settled status. I live outside the UK now. For how long I have to return to reset the countdown?

So basically we’re saying the same thing that they would need to maintain continuous residence for both status right? Re reading your post I can see that you meant to say the same thing, but did not spell it out. They would need to maintain a continuous residence that has begun before December 31st...

Re: How Do I Get A Settled Status BRC?

Or do I have to apply for another BRC showing my settled status? And how do I apply? Where do I apply? As advised above, read carefully what the letter tells you. Maybe wait some days, then if nothing comes, you can apply to change from an (expired EEA BRC) to a new EUSS BRC here: https://visas-imm...

Re: How Do I Get A Settled Status BRC?

They should technically issue one Not really. They don't usually issue one if at the time of granting status one has a valid biometric card. Given the card expired the same day is a tricky border case. I'd say there's a chance of this being a "computer says no" case, and that a card will not be iss...

Re: I have pre-settled status. I live outside the UK now. For how long I have to return to reset the countdown?

I just want to be able to visit for the amount of time necessary to keep resetting the 2-years countdown. You cannot "keep resetting" your status. It does not work that way. If you have already broken your continuous residence period, your status will expire on the 5th anniversary of your pre-settl...

Re: I have pre-settled status. I live outside the UK now. For how long I have to return to reset the countdown?

you will need to make another application once your pre-settled status has reached the 5 year mark If the continuous residence has been broken they will not qualify for either of pre-settled or settled status. At every application, one needs to justify a continuous period of residence that started ...

Re: British citizenship for spouse

Thanks! One more question: if I become a British citizen, does it have any implications to the pre-settled status of my spouse? It was issued on the basis of being a family member of the EU citizen and becoming British affects that basis: does it matter in any way? There is the question of your spo...

Re: British citizenship for spouse

1. If I become a British citizen, does it mean that the earliest date my spouse can apply is early 2025? It depends when you get British Citizenship and when your spouse gets Settled Status. The earliest your spouse can apply for Settled Status is autumn 2024 (see answer below). You will need to wa...

Relationship started November 2021. The crux is here. " The relationship must have started by 31 December 2020 and must still exist. Italian citizenship is sometimes reinstated as if it was since birth - not sure if it's relevant here, but could be.
True. If, and only if, the OP's son arrived in the UK before 31st December 2020.

I believed that after he provided the documentation with his Italian passport from the EU, he could continue independently and attain full pre-settlement rights, considering his immigration status would now be ‘Pre-settled’ and not associated with an EU settlement family member. Hi, this might be a silly question but how someone can obtain settled status in 4 years  If by that you mean 4 years of total UK residence, this is not usually possible. As far as I know, this is possible for children for EU citizens who have Settled Status, but not for any other joining fam...

I also gave him a share code which I had generated. This is useless outside of the UK. Share codes are not meant for airlines, but for landlords and employers, and other UK authorities, to check your status. Airlines will always want a physical document, so it's usually best to travel on the streng...

Re: Settled Status still showing up on website one year after naturalisation

I am starting to suspect that the language used to refer to an individual's immigration history was designed for non-EU nationals, because immigration was not an issue for EU nationals. For instance, wording similar to "wiping out" of one's immigration systems could refer to contexts where the indiv...

Settled Status still showing up on website one year after naturalisation

Just useful information I confirmed today: My Settled Status still shows up on the "Prove your status" website , even though I naturalised over a year ago. Wondering if other people have also confirmed this, and wether this works as emergency measure at border controls, e.g. A dual EU citizen with E...

Re: Irish citizen got pre-settled status, yet is considered settled in the UK by law?

I guess I’m trying to figure out if she needs to renew her status in 2024 so that I don’t have any issues renewing mine in 2026, or whether this is all a non-issue considering the court ruling. Difficult to tell how straightforward the process would be if he does not "renew", but as of today, upgra...

Re: Irish citizen got pre-settled status, yet is considered settled in the UK by law?

Appreciate everyone’s responses and thoughts about the situation. I think we’ll just chalk it up to a mistake cause in my mind there’s an inconsistency in her status as being both settled (by citizenship) and pre-settled by their judgement. Keep in mind this is a non-issue. He is Irish, and he does...

Re: Irish citizen got pre-settled status, yet is considered settled in the UK by law?

When my Irish citizen spouse applied for EUSS back in 2019, she got pre-settled status. As an Irish citizen, she didn't need the status, but only applied so that I (Canadian) can also apply under the EUSS. Not directly answering your question, but on a relevant tangent: Your spouse having Settled S...
