Our appeal has been accepted and they asked for an outline of the defence, which our lawyer is providing. No date set but as I understand it the Home Office may yet back out when they see the defence.

The only information I could find says an 83 week wait for Entry Clearance Officer cases. At that point our son will be over the age limit.

I know that there is potentially a year or more delay for criminal cases, does that apply to immigration cases as well?

Court date wait times

We applied for an EU close family member visa with legal assistance. The HO rejected and we had the lawyer appeal it via the court. We have been waiting for a court date since August.

Obviously there are huge delays due to COVID. Anyone got any idea how long we will be waiting?

I don't think this is right. We are currently pursuing SS route for a family member with legal assistance and have been advised that it is still possible.

Is your spouse an EU citizen? If so then you can apply via the app.

My wife was not an EU citizen and we had to make a paper application, but like you as we had recently returned we did not have utility bills and the like but were able to apply anyway.

They generally send a refusal as soon as they find one reason to refuse, so it probably just means the others are still being decided. Re-submit the brother's one corrected ASAP.

My advice is leave and don't come back. The UK is going down the drain with brexit and increasingly bad immigration rules. You will probably find you like Spain or wherever you go more anyway. Heard back from the lawyer. He says the basis of the application would be Surinder Singh and that the rights continue even though we were forced to move back to the UK.

Yes, we would have been better off staying in Ireland. They didn't join us there and the father died years ago.

Thanks for your help, that was my understanding too. I will talk to the lawyer more, it seems like he has his wires crossed.

Thanks for your reply. One is 8 and the other is 19. I understand that the 19 year old won't be able to get a child dependent visa under UK rules, but EU rules allow up to age 21.

Is there a phone number you can call for updates on your application? When you call the number on the HO website none of the options are right and it just says "wait at least a month". Well since they have all our ID cards and passports that's making life pretty difficult and we need them back ASAP...

You dont need to send passport unless they ask you to. Its scanned when you go to give in your biometrics and you take it back straight after. Is this the right thread? How long did you have to wait after applying to get your passport/ID card back?

I need to travel and my spouse needs to register at the GP etc and the HO has her only forms of photo ID.

EU Settlement Scheme Family Permit is for people with partners who are also applying under the Settlement Scheme. Because your partner is Irish they don't need to use that scheme.
