That's what I thought, but what does it mean "if you’ve lived in another EEA country with an eligible family member who’s a British citizen"? Heard back from the lawyer. He says the basis of the application would be Surinder Singh and that the rights continue even though we were forced to move back to the UK.

Yes, we would have been better off staying in Ireland. They didn't join us there and the father died years ago.

Thanks for your help, that was my understanding too. I will talk to the lawyer more, it seems like he has his wires crossed.

Thanks for your reply. One is 8 and the other is 19. I understand that the 19 year old won't be able to get a child dependent visa under UK rules, but EU rules allow up to age 21.

I am British and my wife is Chinese. She has pre-settled status after making a Surinder Singh application (previously lived in the EEA together). She has two children, both Chinese living in China. We were told by a lawyer that we could apply for an EU Settlement Scheme Family Permit. Is that right?...

You dont need to send passport unless they ask you to. Its scanned when you go to give in your biometrics and you take it back straight after. Is this the right thread? My spouse is applying to the EU Settlement Scheme as a non-EEA citizen. The application form said they need her passport as ID sin...

How long did you have to wait after applying to get your passport/ID card back?

I need to travel and my spouse needs to register at the GP etc and the HO has her only forms of photo ID.

EU Settlement Scheme Family Permit is for people with partners who are also applying under the Settlement Scheme. Because your partner is Irish they don't need to use that scheme. Yes, so you are not an EEA citizen, and your wife is. So your wife is exercising treaty rights (Freedom of Movement) and you can apply as her spouse I think.

The children of non-EU family members can apply to come to the UK under the EU scheme. What happens if the non-EU family member applies for pre-settled status?

In that case can the children still use the EEA route?
