Re: Can't send documents within timefram what to do

I wouldn't trust the HO officers, they are known in this forum for giving wrong advice quite often. My personal experience with them is also quite bad. I would really recommend calling a lawyer about this.

Re: Can't send documents within timefram what to do

Do you have a photocopy of the passport? That might do for now. Explain in a covering letter the situation and that you will send the original as soon as you retrieve it.

You might also want to call an immigration lawyer and see what they recommend.

Re: Unsuccessful applications

1. An EEA(PR) holder can previously have "overstayed" if they were not an EEA national at the time, they had leave to remain, and they remained in the country once that leave expired. So the answer is: yes. UKVI will take into account the previous 10 years, so will look beyond the qualifying reside...

Re: Good character - immigration history EEA national

I'm in the same situation with muraenidae. I'm an EU citizen and got PR document recently. I was a student from Oct 2006 to Dec 2012 without CSI. Could any of the moderators/experienced members tell us what happens in the case you do not have CSI before you get PR document? Is this considered breach...

Re: Online Application - Document Section

Hi, I had a similar problem and I ticked the boxes so I can continue and make the payment. When you download the application form and the list of required documents to send to UKVI the boxes next to the required documents are not ticked (even though you do tick them online). I chose not to tick the ...

Maternity leave & DCPR application

Hi everyone, I would like to know if there is an EEA citizen here in the forum (or if anyone knows of one) who took 52 weeks maternity leave within the 5 year qualifying period and was successful in their application for a document certifying PR. My situation is a bit complex. My contract ended duri...

Re: From 12/11 PR Document Required for Citizenship Applicat

Hello, I have my appointment on the 10/11. All my documents and papers are ready, but I don't hold a PR. Shall I already apply for it? Or they will let me know if I have it at a later point? Is there the risk they will reject my application because I don't hold one? According to the updated Guide A...

Ishjon wrote:Hi, does this new rule of holding PR before applying for naturalisation also apply for those who applied already for naturalisation without holding a PR?
As per first post by Obie this new rule will come in effect on 12/11, thus it does not affect those that have already applied for naturalisation.

Re: Changes in citizenship App from 12/11 PR Doc Required

Hi All, I am from a previously known as A8 EEA country and I registered with WRS which was approved on July 2008. Ever since I have been living and working in the UK. My citizenship application was refused on 20 October 2015 as HO says I have not met with the residency requirements. I have given ev...

Re: Is the new Law on evidencing PR status lawful

New Regulation is coming into effect on the 12-11-2015, requiring EEA national and their family member to evidence the Right of PR by means of a document issued by the Secretary of State. This Regulation seem on the face, to have been effected in total ignorance and in complete disregard to EU law,...

Re: Is the new Law on evidencing PR status lawful

I am with you Obie. From the evidence you provided it seems that this new requirement is breach of EU law. However, I am not a lawyer so I would really like to hear what immigration lawyers have to say about this. What surprised me is that the Home Office did not give any prior notice like they did ...

The PR card requirement will actually come into force on 12 November 2015 so the NCS advisor was right.

Re: Permenant Residence Card required for British Naturalisa

Unfortunately, the permanent residence card is now a requirement for EEA nationals applying for citizenship. Booklet AN and Guide AN documents have been updated on 28 October and they specifically refer to this requirement. There is nothing about Treaty Rights anymore, just the PR card. They do not ...

Re: Changes in EEA citizenship applications from 12th Novemb

Hello, I hope this is the right forum! My first post, and other posts have been very helpful. I'm about to apply for citizenship as an EEA national. I've been here for 8 years, registered with WRS when I needed to, have 7 P60s to prove residency etc. We don't have the documents certifying permanent...
