Re: Deport First, Appeal Later policy ruled out Unlawful

Thanks Obie; much appreciated for the link. Being a layman, I found the information very diffciult to reconsile with my case. It's truly a job of a legal professional. Can you please advice me, what would be the best of action at this stage. 1) My appeal for ILR has been refused by the FTT; my barri...

Re: Deport First, Appeal Later policy ruled out Unlawful

Dear Obie Thank you for your reply; always appreciated. These were the wordings of the FLR (FP) decision; Certification "After considering all the evidence available it has been decided that your human rights claim is clearly unfounded and it has been certified under section 94 (1) of th Nationality...

Re: Deport First, Appeal Later policy ruled out Unlawful

Hi there Can someone please advice if this rule will also be applicbale to me as metioned in the decision; The extended power does not fall to be considered in these appeals but our decision today will surely impact on the extent of its lawful exercise." (per Lord Wilson at para 9). 1) My FLR (FP) A...

Re: 10 years long residence applications

You got to give it a go; infact if a barrister is confident then you shouldn't lose any heart. I think, if you withdraw the appeal and re-apply within the certain days ( i am not sure about the days) then you have a continous residency. As long as you didn't go for a Judicial Review and had your 3C ...

Re: New EU deal: Free-movement rights gone?

I am really confused about the 'prior lawful residence' bit. Does it mean prior lawful residence at any point in time? i.e. would my two years in the UK on a tier 5 visa count? In my humble opinion, you will have a continous lawful residence if you leave the UK while you still have leave to remain ...

Re: Judicial Review and successfully got ILR (10 years Long

@secret.simon I had applied for my ILR on 13th Feb, which was unfortunately refused. They gave me an option for administrative review, which I filed today. My current leave expires on 04th March. The AR decision will definitely come after my current leave has expired. I understand that my stay is c...

Re: Judicial Review and successfully got ILR (10 years Long

I am not sure if it also includes the time while your application is still under consideration and hasn't been decided yet. No. Here is where there is a major diversion between the UK Immigration Rules and the EEA Regulations. Under the UK Immigration Rules, if you have valid leave and you make an ...

Judicial Review and successfully got ILR (10 years Long Res)

Dear All Can you please share your experience if you had or anyone you know was; Awaiting JR (even if at the permission stage) and then withdrew ( because you had completed 10 years) and then went on to successfully get ILR. I had some advice from the senior members that unless and until the JR is s...

Re: FLR (FP) been refused with no Appeal right & leave UK no

This OP on this thread was wrongly advised. Is leave was certified and a removal notice issued. The removal notice has the potential of stopping the ILR clock. He/she should challenge the certification and the removal via JR and then make the ILR The advise that the OP should make a set LR applicat...
