Re: Pre-settled status: Absence of 2 consecutive years

I understand that the required period 5 years of residence for the settled status will be interrupted if the person has stayed out of the country for 6 months+ in any 12 month period. This is clear to me. In another context, it also states that the pre-settled status will be voided after an absence ...

Pre-settled status: Absence of 2 consecutive years

Dear all, I'm trying to understand the definition of "2 consecutive years". I have not found the needed answer in any government guidance or other sources. Situation -Absence March-July 2020 (Corona related) - while maintaining residence and UK employment -Left UK in September 2020 (no more residenc...

Re: Pre-Settled Status: understanding absence calculation

https://www.gov.uk/guidance/coronavirus-covid-19-eu-settlement-scheme-guidance-for-applicants#above You can stay outside the UK for up to 12 once (in one year) and can officially argue like this "absent from the UK for another reason relating to coronavirus, for example, you left or remained outside...

Re: Pre-Settled Status: understanding absence calculation

Well, but that would mean I could be absent for 12 months in 2020 and again for 12 months in 2021. And in the end the residency requirement for settled status would not be affected?

As good as it sounds, I can't really believe it since this would undermine the whole set of rules.

Hi, can't directly comment on this but maybe the absence calculator from the3million group helps? https://www.the3million.org.uk/absence-calculator
Thanks for this. I have noticed this in another post, but I'm not clear on how and if my first period of absence counts.

Pre-Settled Status: understanding absence calculation

Hi all, I understand that once I have been absent from the UK for more than 180 days in any 12 months period, I can no longer apply for settled status. I also understand that my pre-settled status will become invalid once I have been absent for 2 years. I as absent in as below: Mid March 2020 - End ...

She may be unable to retain a right of residence without a divorce.
HI Vinny, do you have a link to official Home Office guidance (i.e. one of these lengthy PDF documents) on this?

This is both given. We are married for about 5 years and we are in the UK for 2.5 years. Do you have a link to official Home Office guidance on this? https://www.gov.uk/settled-status-eu-citizens-families/not-EU-EEA-Swiss-citizen Thanks for this. We have both already been granted pre-settled status...

Re: Right to remain of non EEA partner after seperation/ divorce

Her current "Family member of an EEA national" Visa is valid for 3 more years. However, if I have understood correctly, this won't be valid anymore once I left the UK even if we would just stay married. Correct? Yes, I agree. Article 10 cards bearing the mention "Family Member of an EEA national" a...

You said you guys are married for 5 years and been in Uk for 2 years and half, it all means he can stay in uk without. He is legally required to apply for retained right of residence, if she had a job to enable her to live and work in uk with you unfortunately. 5years or marriage and 2and half year...

Re: Right to remain of non EEA partner after seperation/ divorce

Hi Zerubbabel, Thank you for your reply. This is both given. We are married for about 5 years and we a...

EEA family member card and living at different places?

Hi all, unfortunately it is not working well between me (EU citizen) and my wife (non eu). I'm thinking to move out and she would move closer to her workplace. We would remain married. She has a EEA family member residence card which was issued about 18 months ago. Are we legally allowed to live apa...

Qualified Person: income requirement for being self-employed

Hi all, I've tried to find something on this topic, but failed so far. What is the income requirement for being a qualified person through self employment? Is it the same as for being employed (i.e. reaching an income level which makes NI contributions obligatory)? Thanks in any case. Best wishes, N...
