Profits are retain in the company, understood, but where is your earning's ?


I mean if you have not taken any income from company ( dividend or Salary ), than how you are except to meet earning requirements ?

Just make sure all the details are same including bio-matrix number on both cards, if brp card number is different...

But if I were u I will apply Set I'll ( 10 year I'll ), because if they refuse u will get appeal rights.

@cruis HO do not dig into that deep as the way you have explained, they are more concern that your tax return reflect's the points that you are claiming, in you case you only needed 35k and your SA302 does reflect this. That nothing, I know some one who is waiting for more than 6 month, and to be frank HMRC is not even obliged to amend if tax year in question is more than 4 years old. :(

( The fact is they do have access to HMRC data and they can see your tax history if the chose to do so or not depending on case worker, I would suggest u not to mention/send any thing related to your tax amendment, By explaining your tax...

It can take upto 2 weeks for HO to come back to your employer ! Quicker Some time but HO is very slow in responding to such queries.

When did you first came in this country ?

By Any chance you are entitle to 10 year ILR ( SET (LR) )?

If not 10 year ILR, than you can apply AR First and than send them PAP if still refuse than Apply For Judicial Review ( During JR you are not entitle to work as 3C Finish once the AR Review is done )

Did u pay Cooperation Tax for that Year in Question and If u did, was it declare on time or were amended later ?

I suspect you did not pay your corporation tax on time and even if u did you did it later, which become suspicious to home office. Hence the reason for refusal.

You need to fight all corners. It is a tough fight but you do not have any other options. As once deception has being imposed all further application get rejected automatically. Have they given you a right of appeal ?

Also when you first declare the income to hmrc how much less income did you declare ? ( Difference Between HO and HMRC )
