Where it is mentioned that you will have to apply within 14 days after refusal. It is 28 days after you become overstayer. And when your AR is refused then after two days of overstayer time starts. You then need count 28 days after your AR refusal.

Dear ddiva, After 4th of July he will be out of 28 days of overstayer and his LR option will not be available anymore. you can only apply within 28 days of refusal. They have no idea what they are doing. My AR had been refused and in my case I've got exactly same stuff word by word. Mine 322(5) removed. Now left with 245cd(d). If you made another application before visa expiry, yes your section 3C continues. But as I mentioned above ask employer todo a check. If you used your qualification as part of your previous Tier-1 General application then check application form there is an option that you can use which says:
Qualification recognised on the points-based calculator and evidence submitted as part of previous Tier 1 (General) application.
