Re: EU Treaty Section

Just another update on the 'games' INIS plays with people. No matter how good your application is they find some issue. They tell you if you change jobs (the EU citizen) you must inform them. So I informed them with a copy of my new contract. So they reply asking for two payslips from my new jobs wh...

Re: Eu Treaty files waiting time - EU1 or EU1A

This is in relation to my husband's application. EU1

Date of Application: 30/07/2018
Date of Acknowledgement letter: 13/09/2018
Date of Stamp 4 received: 22/10/2018

Still waiting for final decision and they keep trying to find problems in the application requesting more documents than needed.

Re: Returning to Ireland with my non-EU spouse in possession of a residency card issued under article 10

Hi, So I just recently came to Ireland with my non EU husband. We went through the EU section and were told to go to the EU section. On a previous occasion, we went through the EU section and nothing was asked and his passport was not stamped. This time they asked questions and then sent us over to ...

Re: EU Treaty Section

If you feel that your rights under Union law have not been respected by the national authorities of a Member State, you should first of all take up the matter with national bodies or authorities. This will often be the quickest and most effective way to resolve the issue.Depending on the system of ...

EU Treaty Section

Hello, I just wanted to share my experience with the EU Treaty Section of INIS with you all to make you aware of how misleading they can be. As I have recently posted here, I am planning to return to Ireland with my non EU husband who has a EU residence card based on Article 10. I wanted to get some...

Returning to Ireland

Hello, I am an Irish citizen planning to return to Ireland with my non Eu spouse this summer. We both live in Malta now and have a residency card for Malta. I am planning to return to Ireland under the EU Directive 2004/38. We recently went to Ireland for a short break and I was relieved at how easy...

Which passport control line to use

Hello, I will be going on holiday soon to Belgium and Ireland with my non EU spouse. I am Irish and we both have Maltese resident cards for 5 years. My husbands card is issued under the directive as a family member of an EU citizen. Anyway my question is related to the airport procedure. I have read...

Re: Spouse Schengen visa denied

Just an update: I searched for jobs in Malta and found one that would sponsor me for a work permit. They invited me for a final interview in Malta and suggested I apply for an interview visa. However, the Maltese rejected even this application under the clause 'intention to leave territory before e...

Re: Spouse Schengen visa denied

Hi Charmender, Congs on your visa. How do you go about contacting European Commission, Migration and Home Affairs, B2 Visa Policy Unit? I am British citizen myself married to a Tanzanian citizen August 2015 last year. We have applied for a invitation visa for my wife to join me on holiday in Malta....

Re: residence card requirements

I haven't applied yet but yes I will be applying as a worker. I will apply with my husband so that our applications can be dealt with together. Well as I just moved here recently and have only been working like 2 weeks I don't have any payslip/money into my bank account. So if a work contract doesn'...

Re: residence card requirements

noajthan, I am living in Malta as an EU citizen and my husband is here as non EU citizen. We both need to apply for a residence card. residence card requirements

I am sure this question has been answered somewhere but if someone can answer again or provide a link I would appreciate it. Are the requirements for a residence card in EU countries standardised or does each country have its own different requirements. If a country is asking for bank statements/hea...

Re: Spouse Schengen visa denied

Final update My husbands visa was finally granted. In the end it was all down to the work of the European Commission. I had a lawyer, I contacted Solvit, I contacted the Ministry of Foreign Affairs, I went through the appeals process. But in the end only the European Commission's investigation broug...

Re: Spouse Schengen visa denied

Yes that is what I was thinking to. I have contacted some lawyers so I will see what they say.

Anyone have any knowledge on the other institutions. There is also the ECHR ad ECJ and I am wondering if I can use them too since the EU general court has also has at least one judge from each member state.

Re: Spouse Schengen visa denied

Update: The EC is investigating my case however the Maltese authorities are given 10 weeks to reply to the EC. The EC then has another 10 weeks to decide what to do after that. It is ridiculously long and they know it. They told me that I should consider national forms of redress to get my rights re...

Re: Spouse Schengen visa denied

Well the latest is that the the visa policy unit of the European Commission has contacted me saying that they believe Malta was wrong in its actions and they have told me they will contact the Maltese authorities for us. Not sure how it will go or how long that will take but hopefully it will give s...

Re: Spouse Schengen visa denied

To be honest they don't care about the directive. its clear that they look for any small issue just to make it difficult for people. They told me today that even if I pay the money for translation and certifying documents this doesn't mean the decision will be changed. When you apply originally you ...

Re: Spouse Schengen visa denied

It really is like a bad joke because its 5 weeks after we sent the appeal that they tell us this. Clearly they didn't even look at it until now. Solvit are honestly unhelpful in my opinion. I have been contacting the people who they contact for me but on much regular basis. I just keep emailing them...

Hi Bach48, Hopefully you are still around. I am in a similar situation as you were. I am wondering what exactly happened during your appeals process. Was it solvit that helped you in the end or did you email someone else too? We haven't had any word from the Appeals Board and Solvit say it can take ...

Thanks mgb they are one of the institution I have sent emails to. You know I get what you are all saying about the tourist visa thing but now that we have applied this way it doesn't seem like that would work because they would just think we are lying now. To be honest though as a matter of principa...

Re: Spouse Schengen visa denied

Yes well the embassy was not willing to even answer any of my questions so I don't intend on calling them again. They told us to take a look at the appeal process on the letter. Basically the appeal will be dealt with by the Immigration Office in Malta. But my understanding is the same as yours mayb...
