Re: Surrender Indian passport in India and apply for OCI in India

Thanks for taking the time in reading my query, and posting a response. Surrendering passport in UK and then going to India on Visa seems logical. Can I please ask how long will it usually take to obtain 12 months indian visa? As I think to be able to apply for OCI in India one would need to have ...

Do I risk losing ILR if I work abroad for my UK employer?

I have obtained ILR in May 2017. I am considering the option of being 'physically' based in India for my present UK employer. There is an option that my present job contract will remain exactly the same, i.e. I will continue to be UK tax payer, whilst being physically based in the India offices for ...

Medical certificate for >180 days absence ILR

Hi, I have situation wherein I wont be able to split my 'more than 180 days' absence from the UK into two 12-month periods at the time of my ILR application. The absence was due to sickness (of 51 days) during my planned annual vacation to India in 2014. For this sickness period I have a hand ...

Re: More than 180 days absence from UK (sick leave) ILR

Hello, I am also in similar (actually worse) situation as I have long absences due to my wife's treatment in India. Sr. Case worker are empowered to make discretion for absences exceeding 180 days on compelling and compassionate grounds. As this is discretion, there are not set rules about it. I am ...

Break of 83 days between jobs on Tier 2. Issue in ILR?

I switched employers whilst I was on tier 2 general visa in 2014. The situation was that my last day at my previous employment was on 8th April 2014. By this date I had received my new tier 2 general visa for my new job. I then took a break of 90 days and went outside the UK, and then started my new ...

Re: More than 180 days absence from UK (sick leave) ILR

30th March 2015 - 31st March 2014 - 190 days (out of which 45 days sickness leave - was paid SSP by the employer in the UK) This will be your problem. There is no discretion for absence, the 180 days allowance includes ALL absences. When were you planning to apply? Can you wait to get the 190 days ...

Re: More than 180 days absence from UK (sick leave) ILR

It will be easier if you list your absence per 12 month cycle. So if you think you qualify for ILR on say, 1 April, count backwards for each 12 month period and list your absences. Thanks for your reply. Please find the details below: 30th March 2016 - 31st March 2015 - 22 days - 30th March 2015 ...
