Re: Would ILR be refused - UK born child before parents settled but they are now

To me sounds, it must be a straight forward with no issues whatsoever to issue him with an ILR. But my lawyer says he is born in UK and a PBS dependent so his only way out is to get MN1 because he says he seen cases in past where such applications were refused and were asked to take the British Cit...

Re: Would ILR be refused - UK born child before parents settled but they are now

HI Mannu, As you and your wife got ILR and your child born in the UK. U need to register him as BC using MN1 form. It doesn't matter whether he born before your ILR and having pbs dependent visa. Register him as BC.Even if child has no visa. MN1 requirement is "at least one of the parent should hav...

Re: AR refusal, Fresh application for extension, and 10year route ILR-URGENT HELP PLS!!!!

there will not be any issue in ILR as the application made within 14 days. But I think between 10th Jan-16th Jan 2017 you could be recorded as an over-stayer and this might affect on citizenship.

Re: Indefinite leavel to remain

Because no tax to be paid and HMRC was informed Seems to me, you are very strict to your understanding but not open to listen anything rather than your understanding. You said you claimed self-employed income in UKVI application. You said no self-assessment submitted earlier for 2010-11 You said yo...

Re: Indefinite leavel to remain

This is much more bigger issue than tax amendment as you completely ignore a self-assessment submission where you claimed self employed income to UKVI and probably no answer is sufficient to UKVI now to validate for not submitting. Even if you submit now (no tax, pay tax), if I put myself in your si...

Re: Indefinite leavel to remain

Even when you declared the same figure, in this case, no amendent, just submitting same figure to hmrc that you used in your application then? No amendmend, just submitting same figures to HMRC !!! is that means you did not submit anything to HMRC in 2010/11 and now submitting same as what was clai...

Re: Indefinite leavel to remain

my point is that 1) Does that mean the Home office will not accept the evidence if hmrc cleared the tax issue? I mean especially if the same tax situation that was told home office during the application that there was no tax to be paid because of losses and allowance, this is now the same submitte...

Re: Indefinite leavel to remain

Questions 1) based on the above, can I vary my application back to ILR based on tier1 above? 2) would the home office accept it if hmrc cleared and accepted the tax? 3)how does it affect 10yrs rule if possible? 4) what is your advice please Adams Steve 1. You can vary an application to any category...

Re: Can I continue on Tier 1 dependent visa after husband becomes British citizen

I have heard similar stories like you but only when the main applicant (your husband on this case) was on tier-1 but settled via different (Long residency) route. In such situation they advise the dependent to move ASAP to family/spouse visa. May be you can only explain them that your Husband got th...

Re: Long Residence (LR) continuity

If you do not have valid leave on the day you made an application is an out of date application. Hence your SET (O) too though you made within 14 days . Your continuous residency will break if you get negative outcome on this application. I understand your point but your continuous residency will br...

Re: Long Residence (LR) continuity

Instead of Administrative Review we made the fresh application of SET(O) on 04 August 2017 I believe SET (O) itself is a settlement application, so if this is successful then you do not need any more application (SET-LR). If any negative decision made on your existing application then your continuo...

Re: Final Tire 1 Ent ILR documents list

If I were in UKVI, probably I would also officially advise OP to apply for extension as OP is not completing 5Y but as an applicant I was on the exact same situation and never thought (still do not think) that there was any chance to refuse on this ground. T1G guaranteed: 23-06-2011 extension (2013)...

don't know much about such visits, but I think you can expect to be interviewed about the extension papers which you provide to them and they can test the genuineness of that business.

Their accountant says its not possible to rectify the error as the previous payrol account has been closed it is not impossible to correct it if they really want to. If you go through the form again, you will see on section-3 which category .....

Your dependent must be choosing Section- B (tier 1 dependent) , and section B start with "If applying under section B, please note that you are not required to complete section 9."
