Re: One more ILR Refusal

Hi Gurus, My T1G to ILR application got refused 322(5) due to tax amendment of 2010-11. I applied for Admin review today. I have been to few interviews lately, and There are few companies ready to offer me tier-2 sponsorship visa if required. RLMT is done by them already. Question: If admin review ...

Re: Refused for 185 days absence in 5 years

This is what the guide on ILR says: I think you have a bigger issue to deal with under Tax amendments Thanks for the reply zimba88. My concern it if I am able to contest tax amendment successfully in the JR, do you think this 185 days absence will stay as a bottle neck? As self employed, I only pro...

Re: Refused for 185 days absence in 5 years

It is 180 days per residence year. A residence year is counted from the day of application and backwards. Have you had a total of 185 days of absence in any residence year ? Hi zimba88 It's 185 days in 5 years, not in 1 year. It's been 30-40 a year. The refusal wording is: "We note that leave from ...

Refused for 185 days absence in 5 years

Hi all I received ILR refusal decision on 322(5) grounds for tax amendment. But case worker has also added '185 days absence in 5 years' as a reason for refusal. I did mention the reasons for absences in the SetO form. My questions are 1. Isn't the limit 180 days per year? 2. If I have mentioned the...

Hi tt2016 Thanks for your reply. Not asking exact figures, but can you please provide approx tax you paid after amendment. And any reason assigned for why incorrect SA was done at first place. It will be good to know how we can make our application/reapplication better. Nops, didn't include any acco...

Hi tt2016 Thanks for your reply. You received positive decision in re application with in 3 months. That's good. I too reapplied through a solicitor but HO hasn't made any decision yet. It almost 6 months now. Did you add any accountant letter in your reapplication mentioning the cause of error in o...

Re: ILR postal applications (excluding 10/14 yr.)

Hi tt2016 Did Hmrc update on their systems too or was it just on papers? I too did the amendment to 2013 returns in January this year. But HMRC said they can't update the systems and provided me the amendment on paper. (322(5)) ILR Refused in Croydon PEO - May 2016 Tax amendments 2013 and 2011 (Amen...

There must be a number mentioned on the letter which you received with the BRP. Call them or alternatively, get your visa extended first and then apply for ILR.

Re: Tier 1 General ILR refused (twice) discrepancy 322(5) JR

Thanks monty87 I used to think that for JR, one goes to the High Court. And lower and upper tribunals are for people with appeal rights only. Thanks for clarifying mate. Can upper tribunal judge ask HO to revoke 322(5) even while he is only deciding on whether or not to allow JR application? I thoug...

Re: Tier 1 General ILR refused (twice) discrepancy 322(5) JR

Hi Monty87 Congrats for your successful efforts. I see you mentioned that HMRC updated your tax. Was it updated on papers or on their online systems too? I ask so because I have observed HMRC does send updated SA302 calc paper but never updates it on their system. And HO checks applican't info on HM...

Re: ILR Admin Review- 322(5) Cancelled

Hi TechBro It's unfortunate and wrong too because 19(i and j)are related to earnings' genuineness of self employed. Which means they doubted your earning for current application. And they should have at least asked you if they had any doubt. Any idea how long JR hearing takes? Did they replace 322(5...

Re: ILR Admin Review- 322(5) Cancelled

Hi TechBro Did they replace 322(5) with 19(i) and (j)? They have no idea what they are doing. My AR had been refused and in my case I've got exactly same stuff word by word. Mine 322(5) removed. Now left with 245cd(d). They have done it to one of my friend as well. He got same refusal, but you and h...

Agree on that. Not all can be painted with same brush. People running sham work are different from people who have been refused on grounds of paper work/late filing of returns.

Re: HMRC's VIEW ON PERSON OF GOOD BEHAVIOUR - 322 (5)

Dear Rocktheparty, In the refusal, Homeoffice could say a late submission 'As deliberate' with in the immigration rules or non-mandatory/dicreationary 322(5), In HO point of view that is right, As they expect the applicants to pay the qualifying years tax affairs with in the tax year, But actual bu...
