Re: Is it important to challenge HO decision (file JR) while Appeal hearing is pending?

Why did you have to amend your tax return? What was your explanation? The problem here is that all subsequent application will be effected if refused under general grounds of refusal previously as per immigration rules so Presenting officer, to some extent, will use this ground in appeal. If you do ...

Re: Tier 1 General to Settlement

Have you checked your hmrc record for initial and extension applications and does the record match with income you showed to ukvi in previous applications?

Re: Ilr refusal

@riz

Sorry to hear about your refusal.

What was your situation and explanation for HMRC tax discrepancies? Its very likely that set(lr) will be refused due to 322(5) imposed by HO unless it is challenged in the court.

Re: Fresh LR ILR Application and JR in Parallel

It does not make sense to challenge and apply same category ILR application (if first application was also set(lr). Its more then likely to be refused pursuant to previous grounds of refusal. I would suggest to either challenge refusal or apply again addressing previous shortcomings with further evi...

Re: ILR Tier 1 (General) Application Rejected: Please Help

@ QueryMakerK/ In my own experience to have successfully challenged 322(5), I personally think it depends on your reasonable explanation for not submitting tax returns on time as HO is well within their rights to verify your income with hmrc which you relied on for earnings and was awarded points. T...

Re: ILR Tier 1 (General) Application Rejected: Please Help

Might I ask: will my case become complicated as a result of my not having any leave to remain? In other words, should I apply for JR, will I become an overstayer? And is the option of ILR through the 10-year route closed to me as a result of the 322(5)? Your leave to remain(3C leave) will end upon ...

Re: ILR Tier 1 (General) Application Rejected: Please Help

Sorry to hear about your refusal. Did you have additional tax to pay after tax returns submission? And are you a director or self employed? You will need to go for Administrative Review first and then JR. Unless there is Additional compelling evidence to demonstrate that income declared to UKVI and ...

Re: ILR: self -assessment mismatch

It will effect your ILR. Homeoffice scrutinise self employment income and tax paid according to the income declared to HO at the time of visa application.

Expect a bumpy ride sir!

Re: ILR TAX AMMENDMENT WITHIN TIME ALLOWED BY HMRC

Go for AR>PAP>JR 2nd application will not help in this case as you have already explained errors pertaining to your amendments. In your AR, Explain the errors caseworker made by relying on old income which was rectified over 3 years ago, revised sa302s invalidate old incomes, No attempt to avoid tax...

Re: ILR TAX AMMENDMENT WITHIN TIME ALLOWED BY HMRC

Yes, you are right. You corrected it far before your ILR. Did you provide explanation for this amendment in your application? I am afraid, your only option is JR. You can apply again within permitted timeframe and addressing your character shortcomings with documentary evidence explaining errors. 2n...

Re: ILR TAX AMMENDMENT WITHIN TIME ALLOWED BY HMRC

@sidsays

Sorry to hear about your refusal. Its a very harsh refusal by HO if you amended your tax returns over 3 years ago.

What was the reason for amendement and on what grounds HO refused you in relation to 322(5)?

Re: 3c Rights while reconsideration

@bala11 You should be mindful not to let Homeoffice reconsider your decision by consent order and essentially produce the similar decision again. Its better to let the court promulgate the case and make conclusive findings which will possibly be in your favour as Homeoffice has already given in. The...

Re: LR application when set o refused due to tax amendment u

One can miss deadline and if it is legally allowed then they should give benefit of possibility. They can charge you for PEO and then treat is as postal and even they can't meet deadlines so doesn't mean they are dishonest but means they can have issues too. n finally who found the mistake? Re: LR application when set o refused due to tax amendment u

It would still have been better if you submitted expenses report from the same tax years with application as that would have shown the genuineness of error and also Home office isn't going to be much convinced for personal circumstances of tax tampering or blaming accountant. Not sure what exception...

Re: LR application when set o refused due to tax amendment u

Sorry to hear about your refusal. Why did you have to amend prior to ilr? Merit of JR depends on reasons behind amendments. 322(5) is discretionary and if you do not have satisfactory evidence and explanation that it was an error, there is less chance in jr success. Hi Month Glad you replied. Yes a...

Re: ILR refused

Hi every one, 1 – Can I apply for judicial review and wait till September take my JR application back and then go for ILR? The time I spent under JR will they take this into account or will UKVI sees as over stayer? Or the other option I thought of is 2 – Can I go switch to some other visa and then...
