Thanks nice111, they did mentioned that in the letter. The current employer amend the tax code and more tax was deducted since last 2-3 months. I think its better to be safe than sorry so we would apply when we will be fine in either case 3 or 5 years.

Your 5 years for ILR should be counted from your initial FLR(M) which was on 25 Feb 2014.
