You can apply under CAT B as she currently has a salary of more than £18,600 AND in the previous 12 months has earned more than £18,600 from ALL employments. I am saying there is only one procedure and one application form for all claimant irrespective of whether their partner is subject to immigration control or whether he/she is also british .
