The HO will notice you didn't pay tax from that period on. Perhaps you'll have to submit evidence that you both kept in touch while you were abroad. I think he didn't qualify for FLR(M) as his visa was cancelled and he became a person without a valid leave. He should have submitted an FLR(FP) form, but it would have been refused anyway.

How do you know his removal has been set? Did he get an in-country appeal?

I don't know. Maybe you were supposed to be detained but you were not? People who had their FLR(FP) application refused were being detained --like me. The judge released me with citation to art 8 of the ECHR. I'm sure others have been ,..released on the same grounds. Maybe they aren't detaining ...

HO can't dictate whether a British/EU citizen should or shouldn't search for employment. I totally agree with you. I believe your husband will have to appeal against the decision because any future application you guys make will likely to be refused unless the circumstance of his application change.
