Re: Switching from Tier 2 Dependent to Tier 2 General

Just have a minor query, Do we have to submit existing BRP card while applying for new Visa? Like in this case will my dependent have to submit BRP card to apply for Tier 2 General. And if this application is rejected can she come back on her existing Tier - 2 Dependent Visa? Or if we both apply for...

Re: Switching from Tier 2 Dependent to Tier 2 General

She has a permanent job and employer is willing to sponsor. If she can get Tier 2 General then I can become dependent and easily change my job. Will be more stable for us.

Re: Switching from Tier 2 Dependent to Tier 2 General

Use the RMLT that was done for her job through which she was selected. Just couple of days are left before job posting date will be more than 6 months. This will prove she was 'pre-selected' as she was already 'selected' and is in the job. Her employer posted another job ad in August for a quite si...

Re: Switching from Tier 2 Dependent to Tier 2 General

Thanks for your replies. She can opt for 1 of the three options: Use the RMLT that was done for her job through which she was selected. Just couple of days are left before job posting date will be more than 6 months. Her employer posted another job ad in August for a quite similar profile (not exact...

Re: Switching from Tier 2 Dependent to Tier 2 General

Yes, there can be complications. The employer has to prove that there is no EU or British citizen or person with ILR that is suitable for the job and that your wife has not been 'pre-selected'. Pretty difficult if your wife is already working for the sponsor. Is it a specialised job? How long has s...

Switching from Tier 2 Dependent to Tier 2 General

Hi, My wife is on tier 2 dependent visa and working in UK. Her employer is willing to provide her CoS and tier 2 general visa. She joined this job 4 months back and they posted ad for that job for almost 45 days. Will the employer again need to do RMLT or can they use the previous ad? If yes, Does s...

Re: Working in Wife's LTD company as part-time consultant

Oops, I thought you're asking the employer not umbrella company. So I can work if the employer is paying me directly for any part-time work that I'm doing for them. But if the employer is paying through a third party or umbrella then I can't. Is that right? Please pardon my ignorance on this.

Re: Working in Wife's LTD company as part-time consultant

It's a service providing company but I would not like to disclose the name here. Hope you understand. I was looking at the option of Ltd company just to save on tax. Can I work directly for this company part-time?

No, this would be contracting and is not allowed.
Ok, my employer is flexible. How can I then work part-time legally?

Re: Working in Wife's LTD company as part-time consultant

You wife's company would employ you but can only do work for that company/employer, not for another via an intermediary. Don't even think about it, HMRC aren't stupid and Hector will rip you a new one for even trying it. Look in the ILR forum for dozens for folks being denied ILR for taking on HMRC...

Re: Working in Wife's LTD company as part-time consultant

It does not say you are allowed to contract. And to be honest, working for a company that your wife 'owns' will almost certainly raise eyebrows with HO. An example of what your quote refers to is if a Dr has a Tier 2 G with a NHS trust, but does 20 hours of extra work in the same capacity at anothe...

Re: Working in Wife's LTD company as part-time consultant

Contracting on a T2 is not allowed no matter how much you try to hide under a legal framework. Thanks for your reply, but it does say that "the Tier 2 visa allows a small ammount of work but it must be - related / same profession AND level of professional work as the original sponsored work - not m...

Working in Wife's LTD company as part-time consultant

Hi, I'm working in UK on Tier 2 General Visa, I've some opportunity to work part-time (under 20 hours) as a contractor in the same line of work as per my COS. I don't want to go through an umbrella company as this will push me in 40% tax bracket. Can my wife (Tier 2 Dependent VISA) open a LTD compan...
