25 June 2018 Home Office publishes further details on post-Brexit settlement scheme for EU citizens https://www.ein.org.uk/news/home-office-published-further-details-post-brexit-settlement-scheme-eu-citizens "But the main concern relates to the draft immigration rules. also, here is an article about Family Leave to Remain under the Parent route - FLR(FP) http://noadvertisingspammer.org.uk/archives/839 "Since many of the FLR(FP) categories have been brought into the Immigration Rules in 2012, however, there has always been triage in Sheffield – those applications t...

Re: Derivative Residence Card

Hi, The UK is leaving the EU in March 2019. A derivative residence card is a right imposed on the UK by the EU. There is no guarantee there won't be a hard Brexit which means that the EU based Derivative Residence card will not be valid unless Parliament takes action. Even if the UK has the transiti...

Section 6: Personal History & 26(1)(c)

Section 6 asks about criminal convictions, cautions, any civil judgments or civil penalties.

It asks if you have received a caution in relation to a criminal offence. How would I check to make sure this never happened?

Re: Zambrano Carers Post Brexit

How old is the child? To the best of my knowledge, your Zambrano card runs out when s/he ceases to be a child at 18. 16 yrs old currently so the card expires in 2 years. The crucial difference is that in UK law, it is your responsibility to prove the last condition too, that it is not reasonable to...

Moving from Zambrano to Family Leave to Remain(FP)

Hi, I currently hold a derivative residence card. I am a "Zambrano carer". Today I submitted an application for leave to remain in the UK on the basis of my family life as a parent and on the basis of my private life in the UK. I am curious to hear of anyone's experience with the application process...

Re: Zambrano Carers Post Brexit

If you have Zambrano status, it is no-brainer to apply for Leave to remain. That's good to hear. I hesitated because it took so many years and court hearings to get my derivative residence card. Another question: If I apply for the Family Leave to Remain and the child becomes an adult during the pr...

Re: Zambrano Carers Post Brexit

Many EU citizens appear to be filing paperwork to gain permanent residence. Should Zambrano carers file for leave to remain, too? A solicitor recently told me not to risk filing for leave to remain. Apparently, if the Home Office rejects the Leave to Remain application, the previous Zambrano applica...

Zambrano Carers Post Brexit

Will Zambrano carers automatically get the right to remain? "There is wide agreement, among the public, politicians and business, that EU citizens are welcome here and that the government should make clear they can stay," -Gisela Stuart, the Labour MP who campaigned for Britain to leave the European...
