Re: Judicial Review - Cost claim by UKVI at AoS stage

Hi Obie, This is what confused me. They have not sent a consent order. The above extract is from the AOS form they've submitted to Upper Tribunal and my Solicitor. Can we send a consent order in response to this AOS or does it have to be initiated by UKVI? I'm just worried that this can be one of th...

Judicial Review - Cost claim by UKVI at AoS stage

Hi, My ILR application was refused under clause 245CD and 322(5). I then applied for the Judicial Review in Oct'17 and after 42 days I received the AoS (Acknowledgement of Service) from UKVI. UKVI has withdrawn the decision and undertaken to provide a new decision within 3 months in light of the evi...

Re: Long Residence (10 years) SET (LR) applications

Which would take me to the end of august'17. Would that cover 10 years. You would need AR to be successful for your overstay to be igno...

Re: Long Residence (10 years) SET (LR) applications

Hi Guys, I need some clarity regarding 3C leave and if I’m eligible to apply for SET (LR) i.e. ILR through 10-year route Brief background: I applied for ILR through Tier 1 General route i.e. SET(O) in Feb’16. I had a tax amendment for tax year 2010/11 so my application was finally refused, after cou...

Re: Long Residence (10 years) SET (LR) applications

Hi everyone, My ILR is under process. I applied under T1 general route. My 10 years are now complete. In case of rejection, can I submit judicial review "and" apply for SET (LR) ? My understanding is that once you submit a new application, your previous case is withdrawn. But I read on another foru...

Re: LR application when set o refused due to tax amendment u

For your JR make sure your lawyer gives reference to the fact that the statutory provisions made through Section 37 of Tax Management Act 1970 allow amendments within 6 years of filing a tax return. Secondly If HMRC has accepted your amendments, which is the tax regulatory body and they don't find y...

@ITEXPERT

JR is a must ! On many occasions UKVI withdraw and grant visa at Pre-action Protocol stage if their lawyers feel they don't stand a chance in front of independent judge.

Re: ILR - Judicial Review Success Story!

Congratulations buddy. I'm in the same boat. I've submitted fresh application and don't have the right to work for past 3 months. I often think that i'd be better off going for JR instead of submitting a fresh application.
