Re: Lounes case, pre-settlement

Hi all I have just got married to dual EEA/UK citizen (june 2019) and want to get a residence card through my husband. He has exercised his treaty rights, got PR on Sept 2018, and got settled status in April 2019 and naturalised UK citizen in May 2019. After that he kept living in the UK (I guess t...

Re: Lounes case, pre-settlement

I confirm. Call them and get the paper form. If you apply online, your application will be initially accepted. You will even get an automatic COA then next thing you know is that your application is bounced and you have to apply using the paper form. You can't apply online for Lounes: if you state ...

Re: EU Settlement Scheme & Toufik Lounes cases

Thank you for your comment. I really appreciate it. I contacted the HO and they said they cannot send it to me unless I provide all the information. I think they don't want to share the form. I find it strange because it's just an administrative form there shouldn't be nothing secret about it reall...

Re: EU Settlement Scheme & Toufik Lounes cases

Anyone can here upload the application form You can only request it via the HO: each application has the applicant names, DOB and ref no on top, so I cannot, I am afraid, upload it, nor circulate for obvious reasons. Call the HO, tell them you are applying for Lounes, and they will send you a paper...

Re: Non-EEA family member of dual citizen - Possible to switch the visa?

I have a similar question. I’m a non-EEA national who is married to a Spanish/British dual citizen. We got married after he is naturalised and he kept exercising his treaty rights after naturalisation. I was told to apply to Lounes case (request paper application form). Is it correct thing to do? S...

Re: EU Settlement: Lounes paper form?

Hello If you apply for EU settlement as family member of an EEA national who applied and obtained a British citizenship, you will be required to fill a paper application. In this document, page 13, they refer to it as the "relevant paper application". https://assets.publishing.service.gov.uk/govern...

Re: Do dual EU-UK citizens have rights under EU law?

Any news or changes in the Lounes case? I will apply for my residence card through my dual EEA/Uk citizen husband who acquired British citizenship recently. How long does it take it to be processed? Which supporting documents are needed? Is there going to be biometric appointment needed? Is the for...

Re: Do dual EU-UK citizens have rights under EU law?

All, amazing news (in my opinion). The HO has published this long faff about settled status https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/718237/EU_Settlement_Scheme_SOI_June_2018.pdf . Hidden at page 24, footnote 16, the HO has, to my knowledge, con...

Re: Do dual EU-UK citizens have rights under EU law?

I read it on the contrary, i.e. Lounes won't be able to obtain PR, but will be able to stay in the UK, live and work.

I am waiting for the full judgment to have a clearer view, but we might also need to wait the high court dealing with this point, if at all.

British naturalisation - proof of residency

All, Can anyone, who has successfully applied for BC, advise on what documents they submitted to prove they have been resident in the UK? I am an EEA national, so my passport does get not stamped every time I enter the UK. Have people submitted letter from employers stating they have been working fo...

Re: Do dual EU-UK citizens have rights under EU law?

Note that I am overly simplifying. Assuming the ECJ follows what the AG said, the judgment will say that the Citizenship directive should be interpreted as not denying EU rights to someone that has exercised treaty rights and then became a national of the country where she/he now resides. The ball w...

Re: EEA(PR) - evidence of employment if applying as a studen

It depends. Did you have comprehensive sickness insurance (CIS) while you were studying? A student does need CIS to qualify, whereas a worker does not. I was in a similar situation (students, plus doing teaching and other uni work) and, when I applied, I made sure to send both (a) proof of CIS (my E...

Re: EEA national (PR) naturalisation and non-EEA on res card

noajthan thanks for that. The reason why we would like to be pro-active is that, as I am sure you aware, art 50 will be triggered (or it is planned to be triggered) in early March. This would make the possibility for my husband to apply for PR impossible (albeit is all a big unknown). Thus, the deci...

EEA national (PR) naturalisation and non-EEA on res card

Apologies in advance, but the topic of this query is cross-cutting different topics. I have obtained EEA permanent residency card in Nov 2015, and I have been therefore eligible to apply for UK citizenship since Nov 2016. My husband is here with me working, and with a EEA residency card, expiring in...
