Re: Updating Now-spouses' Settled Status: Denied... Advice

You are NOT trying to appeal the decision, since the decision to issue pre-settled status instead of settled status is indeed correct. You are simply asking for written confirmation that the wording on your refusal for settled status is wrong , because the reason of the refusal is that your wife ha...

Re: Updating Now-spouses' Settled Status: Denied... Advice

1. You don't need to send her current BRP to get the new one. You can just apply for the new one, and if you want, destroy the old one after the new one arrives. But no one is going to invalidate the old one or come after you if you don't destroy it. I was in this situation and for months I had two...

Re: EEA Unmarried Partner & Pre-settled Status

This was answered long ago. Anything in particular from the below that is not clear? Does she currently have a EUSS BRP? If so, what's the expiration date? 2. If she wants to have a valid biometric card after June 30th to show for her electronic Pre-Settled status, then she needs to apply to conver...

Re: Updating Now-spouses' Settled Status: Denied... Advice

Her 5 years start counting from when she received her BRC as a durable partner of an EU citizen in 2018. She doesn't qualify for settled status until 5 years has been reached in 2023. You were advised in 2021 when Day 1 is of her qualify period (topics now merged). Thank you for this reminder! As f...

Updating Now-spouses' Settled Status: Denied... Advice

Partner and I arrived in September 2016. She arrived on Tier 5 visa. In Q1-2018, she had her durable partnership status confirmed and BRP was issued to her as the unmarried partner of an EU citizen, which required us to demonstrate we'd been in a durable relationship for several years already -- ie ...

Re: EEA Unmarried Partner & Pre-settled Status

Actually, my other half raised a good question: OK, her card expires midway through this year. Say we managed to get abroad (she can travel to the EU easily on her Canadian passport, so covid-permitting, we could get there). On return, should she ever be asked for any proof other than pre-settled st...

Re: EEA Unmarried Partner & Pre-settled Status

Thanks for the thorough response. I've got things down to Day 1 of Year 5 after she received confirmation of her Unmarried Partner status; this is all that matters really. On this day, her BRP isn't really useful anymore. So she couldn't travel with it. But I think you're saying she wouldn't lose he...

EEA Unmarried Partner & Pre-settled Status

I've tried sorting through the existing posts on here, because this combo can't be uncommon -- EEA Unmarried Partner visa, and Pre-settled status. I'm not sure I've found anything clear and concise though. My other half had a Tier 5 YMV for a year, and then we managed to obtain rights for her as an ...

Re: EEA Unmarried Partner - Pre-Settled Status

Not talking PR - - not in the UK long enough to talk PR. Talking pre-settled status. According to the document first linked, it seems this is supposed to be doable under the online system, with a reasonably quick answer - - but I suppose the question is if this is how it will practically work out.

Re: EEA Unmarried Partner - Pre-Settled Status

Interesting. Thanks While my route may be as easy as using a smartphone app, will it likely be that easy for her case too? Or will we have to compile another massive folio of evidence, submit documents, and wait up to 6 months for a decision, given that (as you've cited) a caseworker has to weigh so...

EEA Unmarried Partner - Pre-Settled Status

Re: EEA EFM application

Application was successful. Paperwork returned today. Despite the majority-pessimistic outlook on this (not unjustified), it is possible to get the EEA unmarried partner visa with mostly unofficial documentation that you and your unmarried partner have lived together for only 22 months. I do expect ...

Re: Travel during BRP application - UK citizen & Non-EEA

Is there anyway to keep both passports during this process? None that I've ever of, except in the case of an EEA citizen in possession of a current national ID card, in which case that substitutes for the passport. But only for the EEA citizen, not the non-EEA. EEA citizen and non-EEA citizen can u...

Tier 5 BRP will be With Home Office When We Return to UK

My girlfriend's Tier 5 BRP will be in the Home Office's hands when we return via Gare Du Nord in early April. One one hand, you can scold us for planning travel while applying for new visa/residence rights, but in our defence, the Home Office's/Visa & Immigration's communication re: the use of the P...

Returning Without Tier 5 BRP

Hello all, My partner (unmarried) and I submitted our QP and EEA-EFM visas recently (this question isn't about these applications) using the European Passport Return Service. On submission, my partner had to give her Tier 5 BRP to the office officials because they said they don't do copies of that t...

Re: QP Application: Including Documents

Ah, in fact I think you're correct. So there isn't even a stamp in the passport im submitting... It just has an Issue date that is several months after I arrived and started working. Again, I have provided an explanation to why this is the case, but they won't have my Canadian passport to check. Sin...

QP Application: Including Documents

A QP application query: I arrived in the UK on a tier 5 Youth Mobility Visa in my Canadian passport. I started work shortly thereafter, and only received my EEA-passport several months later. I did not get a stamp in that EU passport until even later (~6-8 months after initially arriving and startin...

Re: EEA Family member (unmarried couple) Help

To the OP, hopefully the advice I give below is not too late. It contradicts the other advice given, but it comes from a solicitor and includes references to case law that the Home Office should be considering when evaluating your application. Whether or not the case worker cares about case law / pr...
