Getting divorce please advise

after 4 years of marriage we come to the point that its not gonna work out. We don't have any property but i have some savings. Do i have to divide it in 2 when getting divorce?

I'm married to an EU citizen who is resident in the UK. I came here with student visa and met my wife 4 years ago. My student visa changed to Spause visa. Question is can i travel to my own country or i have to stay 5 years without interruption to get the ILR? Many thanks
