Re: Do dual EU-UK citizens have rights under EU law?

@ Badis: I'm no expert but I believe your case is pretty much like the McCarthy case, which must of us have been collateral damage of... until the Lounes ruling. If I correctly understood your story, I agree that you have to stay in the 'UK route'. I don't think you can use the 'EU route' (anymore) ...

Re: Do dual EU-UK citizens have rights under EU law?

Hello , @SladeW, I really don't know what to say. It seems that your struggle goes way further than Lounes. I hope your solicitor gets an answer soon and that they give you an opportunity to appeal. I'm sorry I cannot offer any advice. @Silverman, keep us posted re your second application, I hope se...

Re: Do dual EU-UK citizens have rights under EU law?

@SladeW: I am very sorry to hear what you and your family have been going through, on top of the long uncertainty re the Lounes case. I am no expert, and can only speak from my personal experience. I think that if you give more details about you case, and dates, the more senior contributors may be a...

Re: Do dual EU-UK citizens have rights under EU law?

Hello, Actually, I don't think this is an EEA rule. It was probably applicable to a visa I held before, but now I am not sure! My apologies for being misleading!!! Looking for information on this, other visa types have shorter times. Reading through a topic in this website, i read a post from one of...

Re: Do dual EU-UK citizens have rights under EU law?

Correction, I meant parental rather than paternal, clearly Hello everyone, I also received my PR BRM yesterday, valid for 10 years. Regarding citizenship it says that if married to UK citizen, i can apply straight away. I decided to wait until it is 12 months from PR, which my letter confirms is in ...

Hello everyone, I also received my PR BRM yesterday, valid for 10 years. Regarding citizenship it says that if married to UK citizen, i can apply straight away. I decided to wait until it is 12 months from PR, which my letter confirms is in October, so only 2 months away. Just enough time to prepare...

Re: Do dual EU-UK citizens have rights under EU law?

Congratulations chaoscontrol!!! That is fantastic news for your family, and very encouraging for everyone here. I have been waiting for more than 4 months now and haven't heard anything yet. When requesting the passport back, it does say that it may delay the application process, but it had been alr...

Re: Do dual EU-UK citizens have rights under EU law?

Hello, Thanks for the update on the FoI, Branok, however, I have to agree with eubritish, or at least I am not seeing any new insight from their reply. I have a minor, probably unrelevant update: I requested my passport back, and received it exactly 10 days after. For my sanity, I am telling myself ...

Re: Do dual EU-UK citizens have rights under EU law?

I think normal timelines don't apply to our cases - which was what I was originally hoping for.
Seems like our applics are indeed on hold. I sent applic. in late Jan, +4 months and counting...

Re: Do dual EU-UK citizens have rights under EU law?

No news from me, either... other than I requested my passport back a couple of days ago (not sure how useful it will be for travelling, given that my current residence expires soon). @reynaldogr: did you get it back? As you, I'm checking daily. The freedom from info request from a recognised immigra...

Re: Do dual EU-UK citizens have rights under EU law?

Dear CR001, Thank you for moderating this thread. I understand your general point about there being designated topics for sharing timelines. But I am not sure I understand what you are suggesting us to do to avoid this topic being closed. To post both there and in the designated processing time for ...

Re: Do dual EU-UK citizens have rights under EU law?

@silverman123: Your arguments make complete sense to me. I join kam999 in thanking you for sharing your positive interpretation of the ruling, and giving us hope. Unfortunately, the HO are not exactly famous for being rational or having a consistently sensible interpretation of the law. The fact tha...

Re: Do dual EU-UK citizens have rights under EU law?

Hello everyone, @reynaldogr, good luck with your application. I agree that it's probably not needed to mention Lounes, though I would expect that by declaring the UK citizenship of the EU sponsor, the case will still be in the same pile of those 'on hold'. Hopefully not on hold for long... I don't h...

Re: Do dual EU-UK citizens have rights under EU law?

No news from me. Had been hopeful the brown envelope would arrive this week, with no luck. After reading posts Kim999 and reynaldogr, it looks like the wait might be long. Funny how in the one Kim999 posted it says they are expecting to make amendments to regulations in the first part of the year, w...

Re: Do dual EU-UK citizens have rights under EU law?

Hello everyone , thanks for updates . Yes , Succsses82 is not covered by TA and he clearly mentioned his sponsors BC and date of naturalisation in application form . I read somewhere online news that HO was aware of Lounes hearing and monitoring closely . @ Salu did you submitted application throug...

Re: Do dual EU-UK citizens have rights under EU law?

Hello, From Success82 initial post telling us their story, my understanding is that they are also not covered by TA: "I got married to EU citizen in November 2012, applied for residence card in December 2012, got my 5yr residence vignette in my passport in Feb 2013..." As reynaldogr notes in post ab...

I look forward to hearing more success stories, and will update you when I hear back from the HO. I'd be very interested in hearing about everyone's timelines. Good luck!
