Re: Passport application for MN1 British Citizen

If your daughter is British now, she's British still, the certificate proves the fact, and immigration regulations are no longer applicable! So for British passport daughter's registration certificate and her foreign passport are sufficient. Not familiar with the ILR process so hopefully another me...

Passport application for MN1 British Citizen

I am a British citizen by descent, my wife is Japanese currently living with me in the UK on a spouse visa (not yet ILR). Our daughter was born in Japan and so I had to apply for her British citizenship via MN1. Both my daughter and her mother returned to the UK on 1/8/22, my daughter entered the UK...

Re: British Citizenship by descent of foreign born British Citizen

Possible. However, a Chief Immigration Officer also has powers to refuse entry for visa holders, although it may be unlikely for a child. Thanks again Vinny. https://www.gov.uk/government/publications/form-mn1-guidance/form-mn1-guidance-accessible-version#documents In the above guidance " Section 3...

Re: British Citizenship by descent of foreign born British Citizen

Perhaps you could ask a Chief Immigration Officer at the intended port of entry ? If their response is favorable, then don’t forget to get his/her full name for reference. Do let us know their response. Is it possible in this scenario to apply for a visitors visa in advance, rather than the decisio...

Re: British Citizenship by descent of foreign born British Citizen

If you have spent at least 3 continuous years in the UK before your child’s birth then child may be entitled to register under Section 3(2). Else, child may be entitled to register under Section 3(5) after residing in the UK for 3 continuous years with parents. 3(2) gives child citizenship by desce...

Re: British Citizenship by descent of foreign born British Citizen

Does my wife’s spouse VISA not allow her to bring the child with her when she returns to the UK? No. The visa your wife will be issued is for her alone. The child will need their own visa in their own passport. If you are a British citizen by descent (because you were born in France), you have a ch...

Re: British Citizenship by descent of foreign born British Citizen

Option (b) sounds most practical but not while in Japan. As Japanese citizens can remain in UK for up to 6 months with no particular visa anyway can we apply for the baby’s permanent VISA once in UK? In don’t see it being feasible to apply while in Japan (given the evidence required based on the li...

Re: British Citizenship by descent of foreign born British Citizen

If your father was in the British crown service when you were born in France, then you may be British otherwise than by descent? If you are British by descent , then your child is probably not automatically British. If child is not British, then child may apply for a child settlement visa under App...

Re: 180 day limit - special conditions

No effect on applying for indefinite leave to remain before her visa expires. She will be required to submit 2 years evidence o...

Re: Spouse VISA extension preparation

] Thanks, I read that they have to be from multiple source At least 3 sources Can I ask how much flexibility is there with this request? Can we print out historic statements if we haven't received them in the past? If we don't have the full period from 3 separate sources will the application be out...

Re: Changing surname BRP card

website states that we have to inform of her change of name within a certain period, I assume there's some leniency here? Usually it has to be done within three months but given the present ambience of backlogs it won't be tangibly enforced As for receiving an email about use of exiting biometrics,...

When she originally applied her passport still had her maiden name, but since she had to renew her passport she has updated her surname to match mine. I understand that she now needs to update her BRP card with her new surname and ha...

In line with her expiry date - June 2021 the relevant period will be June 2019 - June 2021
Thanks, I read that they have to be from multiple sources and spaced by no more than 3 months?

Click here to get an idea of the requirements.

At least CEFR A2 need to meet the English language requirement for extension.
Thanks, have taken a look already although the gov site is scant as usual on specifics. Noted regarding A2, will start preparing, thanks.
