Re: Chance of appeal for ILR(LR)

Hi, I am not expert to give you advice but I read lots of topics and gathered bit idea, so far I understand it depended on case worker to give you appeal right in country or out country in that case, few occasions I have seen that for getting out country appeal right you can do judicial review to ge...

Re: JR/Court Issues Guidance to HO for handling 322(5) rule

Hi Obie and Teddy0409 This is good news at least for few people who are affected for 322(5), I applied ilr through tier 1 general in 2016, later my application was refused beginning of this year, reason was I didn’t declared self employment income in sa302 on time, but I declared within 1 year HMRC’...

Re: ILR refused

I think you should apply for ILR LR if you are eligible, because they refused you 245(d) not 322(5), but I am not sure that are you still eligible for LR as they refused you in March where 14 days gone already but still you have chance for JR, I will suggest you to do both if possible.

Re: Is it important to challenge HO decision (file JR) while Appeal hearing is pending?

Hi Surajid, I completely understand your situation, but I will advise you to stay with appeal as zimba advised you, the reason I am telling you to stay with appeal because there is more chances to get success than judicial review and that’s not right that you have to do JR, if I am in your situation...

Re: Two ILR applications simultaneously

Hi I think you should wait to get the decision from Home office as they said they will reconsider your application, if they refuse you again some reason you will have right to administrative review and still you will have opportunity to apply ilr LR or JR, but I think if you apply LR now may be your...

Re: SET(LR) after ILR through Tier 1 General Refused

Hi Lastresort As far as I know you don’t have 3c leave now, which finished with AR refusal, you can apply for ilr LR but I think they will not give appeal right but you can do judicial report, I have exactly same situation, I have already applied for LR, though few solicitors confused me that someon...

Passing very difficult time, applied ilr through tier 1 g, September 2016,after long wait they send refusal after chasing by MP, the reason they said in 2012/13 I didn’t declared dividend income on time. but my concern is I declared in HMRC provision time that you can make change in one year time fr...

Hi Makky86 Thanks for your quick reply, I am confident that it’s there mistake, I will explain them in the review but just in case if they keep there decision and then if I applied ilr long residency and again if they refuse same reason then I can get appeal right and where I can prove that I wasn’t...

Re: Ilr refusal

Hi Makky86 Thanks for your advice, but so far I know if you apply ILR (LR), when case worker will decide if that time you reach 10 years than you are eligible? I think Riz will get that time because if he applied than will takes at least 1 month to get biometric letter than another 3 weeks to give b...
