Re: Spousal visa application for 'overstayer'

I also meant to ask how long the cover letters should be. My wifes is 2 full A4 pages - she explains: - the financial requirement, - the accommodation plans, - when we met dated, married, met parents, - a paragraph about the FLR-FO rejecting, me being detained but us getting visas to voluntarily lea...

Re: Spousal visa application for 'overstayer'

We had our FLR-HRO pending and requested a certified copy of my husbands passport from the Home Office so we could get married. They sent this to us and we put in for our notice of marriage. After the initial (normal) 45 days they wrote to us to say they were satisfied and did not wish to investigat...

Re: Spousal visa application for 'overstayer'

Hi Alam, thank you for your reply. Those are the things we would be worried about that may cause a rejection so we are trying to work out if they will have an effect and how we can best explain them. I do have some specific questions around them which I've separated out below: QUESTION: will these d...

Spousal visa application for 'overstayer'

Hi guys, I need a little advice please. Me and my wife are going to apply for spousal visa from outside the UK. We meet the financial requirements through savings and will be living with her parents when/if we can return to the UK. I say return as I have lived there for 11 years, 9 with a visa and 2...

Thank you for your help. I really appreciate you taking the time. Re: FLR-FP refusal - next steps

Again bad advice from lawyers. These were the routes he was told to take. I hate that we can't even argue that as an explanation, it would just get ignored. It all started to go wrong with the FLR-HO application. That got refused, advised JR, that got refused now he's deemed an overstayer. At that p...

Re: FLR-FP refusal - next steps

That is exactly what our current lawyer said regarding JR making more money. If only he knew that back then and had the knowledge we have now... I looked up 320(11) and under 1. RFL7.1 When can I refuse under 320 (11) it says: "It is not sufficient to have been in breach of immigration law or to be ...

Re: FLR-FP refusal - next steps

Bathanza - thank you. His passport is valid, he has English tests (he studied at Uni here as well and has qualifications), savings definitely meet requirements and been with me for 6 months (just but add on few weeks to get application in and it'll be more like 7 months) and accommodation here would...

Re: FLR-FP refusal - next steps

Today was horrific. It was report in day and they detained my husband, sent him to detention centre. I didn't see him before he went. I did get to speak to him when he arrived and were now trying to work out next steps. Reason for detainment is he's an 'overstayer' but we don;t understand how - his ...

Re: FLR-FP refusal - next steps

Ah ok thank you bathanza and physicskate. So he must currently either have Visa which he is renewing (i.e have existing leave to remain) OR have strong exceptional circumstances (which is how you believe you finally got approved bathanza)? If we go spousal out-of-country are exceptional circumstance...

Re: FLR-FP refusal - next steps

By voluntary moving without any expense from the government will be in your favour. Any ban imposed doesn't count if you did seek entry clearance, for this is the only thing the HOME OFFICE want you to do. Hi bathanza. Lovely to hear from you. I've been following your situation and cried when I rea...

Re: FLR-FP refusal - next steps

Thank you. Regarding the financial element, would the fact that the money has come from his parents selling a house in Sri Lanka go against him, even though they were not living there? And regarding 'adequate accommodation' - we currently live with my parents, mainly to save on money as rent can be h...

FLR-FP refusal - next steps

Hi, hoping to get some thoughts on what me and my partner (Sri Lankan) can do as next steps... BACKGROUND 2007 - Came to UK on student visa and was legally in country for just under 10 years. Jan 2016 - his FLR-FP (before he met me) was rejected, given appeal but was advised to go JR. Nov 2016 - we ...

Thank so for the reply. But they have this section 120 which I tried to find out online what should I be doing and how? No idea what it means. It says: "If you have reasons to stay in the United Kingdom that were not part of your recent application, you must state them. This requirement is being giv...

Re: FLR (FP) unsucessful

What is your full UK immigration history?? You have not posted this information in any of your posts you have made on the forum. What are the 'insurmountable obstacles' reasons you have used for FLR(FP)? Did you get married in an HO approved Registry office, hindu ceremony, islamic marriage.....etc...
