I have received my COA and hr officer is saying that there is a risk they could hire me and the Residence Card would be rejected. So although I have the right to work in the UK currently, there is a chance I might have to leave the UK as the home office can still reject my application. This is gett...

This has got me thinking. Does the vigenette not go in the passport? So, if a request is made for the passport before the application is decided does this not make it void as they can't stick the vigenette in the passport?

There is https://www.gov.uk/visa-documents-returned But I am not sure if requesting the passport back results in the pending visa application to become void. Does anyone know? So, what do you think is the best route for trying to prove I have the right to work in the UK while the Residence Card is being processed and I am without my passport?

Does anyone have a sample of what a CoA letter looks like they can send me with thier application number, names hidden? Would be great to see the form of the letter so I can use as a guide to hr.

Ok so the CoA is about to arrive, probably in the next days. You can request your passports back now, it will be fine.

I have a New Zealand drivers license.

It has been over 10 days since I applied for the Residence Card application. WOuld it be best I just request my passport back?

I can show them my nz drivers license, marriage certificate and wifes European national id card.

You're also confusing obtaining a British passport with British citizenship. They are two separate processes; the granting of BC followed by an application for a British passport. Thansk so in short,

there is no point in me getting my wife to get her british passport and then me applying under UK route as I will have to still wait 5 years before I can get PR

Well, no point in dropping thousands of pounds then - ill stick to the cheap eea route

So the 3 years is mute then no? how can someone apply for citzenship after 3 years if they need PR, which means they need to have lived in the uk for 5 years.

When could someone every actually meet the three year requirement?

Am I missing something or is this the most illogical thing every created?

3 years residence is applicable to apply for citizenship (3 years residence as spouse of BC) but to qualify for citizenship you need PR/ILR which is 5 years residence in a qualifying category.
