If he does end up in prison, he'll still be in the UK which is what matters. The rules on exercising treaty rights were relaxed a bit, so he only now needs to be resident in the UK. Even if you cancel your ILR you won't get your money back. Plenty of people have applied ILR / PR and Settlement Scheme at the same time or one after another That's a shame. How would the home office know she does not reside in the country anymore?

I can convince her to come back (albeit for a quick visit).

Even if they find out when she left the country, how do they decide that she has left for good?
