Surrender Certificate appointments VFS Manchester

Anyone who's had experience of this at VFS Manchester, would you be able to elaborate if they are reasonable with wait times at the centre or whether it's a situation where you are allowed in at the designated timeslot but you may end up waiting an hour or two before your turn comes up? This is ...

Re: Long Residence and 2023 changes to Immigration Bail

I now have British citizenship, I just wanted to bump this one to update this a bit. I essentially complained to the home office to refund me the money under Ex Gratia payments since they made this mistake in 2021, and pay for damages. The money would've been for: 1) The money I spent on IHS in 2021 ...

Re: Naturalisation application - no caseworker assigned even after 10 months

The email you received in March is automated, so unlikely you would have any kind of case in court. Please refer to this guide on how to chase a delayed application https://www.immigrationboards.com/viewtopic.php?f=42&t=343483 You'd think they'd use a less accusatory wording for an automated email.

Re: ILR refused

Tvaswani to answer your question on how they accepted it was their mistake, I did an SAR which I only received last week, and in there I saw notes they made for my SET (LR) application from 2024 where I saw their notes. I posted a screenshot of that note in my thread: https://www.immigrationboards ...

Re: ILR refused

Thanks Nightshade for the reply. Its an open license to refuse for them as if they make a mistake there is no way to hold them accountable apart from taking them to courts. Can I ask if you did a judicial review? do you think its worth it time and offcouse solicitor fees? I am aware its case to ...

Re: ILR refused

Historically SET(LR) is considered a human rights application, so the right to appeal should be granted. This guide has not been updated since late 2023 though, reflecting the changes made in April 2024: https://assets.publishing.service.gov.uk/media/65786efa095987001295def0/Current+rights+of ...

Re: Long Residence and 2023 changes to Immigration Bail

Thanks for this update. This allows us to give out more accurate advice and helps others better :D No problem. Just annoyed that it cost me an extra £4445 to get here, £1560 for IHS in 2021 as they rejected the ILR and gave me FLR (FP), and £2885 for another ILR application this year neither of wh ...

Re: Long Residence and 2023 changes to Immigration Bail

Hi, Just wanted to bump this topic a bit in case it's of any help to someone in the future. I had done a SAR and I finally found out the reason behind my ILR grant. Essentially, Home Office accepted that my refusal in 2021 was in error and that ILR should have been granted back then considering I ...

If he is a director of his own company that will be fine. write down that as his job title (it doesn't matter what his title is at his other job).
Thank you

Hi, This has probably been answered before somewhere but I needed confirmation on it still. Re: Long Residence and 2023 changes to Immigration Bail

You did not mention above that you applied in 2024 (??) but the new rule changes do not allow you to rely on historical 10 years anymore (so the discussion about the changes in 2023 is now not relevant ). The 10 years are calculated from the most beneficial date to the applicant and backwards ...

Re: Long Residence and 2023 changes to Immigration Bail

In 2021 they refused my ILR saying that I didn't qualify as I spent those 4 months without a valid leave (they didn't consider the immigration bail) and granted me 2.5 year FLR FP with no right to appeal. So in my April 2024 application, I argued that I should've been granted the ILR back then as I ...

Re: Long Residence and 2023 changes to Immigration Bail

That is great news, however just so that this topic does not become a hot topic of discussion for other applicants, I believe you applied for your application in 2021 before the major rule changes introduced in 2023 and 2024. You are correct to note that the rules that apply to any application are ...

Re: Long Residence and 2023 changes to Immigration Bail

Hi, I received a decision today and I was granted ILR. The case I made was that Home Office made an error in 2021 in my decision, didn't give me any right to appeal despite it being a human rights application. And additionally, I mentioned that the rules regarding immigration bail is unclear since ...

As you can see above from the discussion we had in 2021, you may have break in your continuous residence Hi, so back in 2021 I actually did not have a break the case worker simply did not consider the start of my immigration bail into account while calculating the days (they calculated from the ...

Re: ILR(Long Residence) eligibility concerning Exceptional Assurance

This is worse than what you even think. They expanded paragraph 39E to cover the Exceptional Assurance BUT then made ALL disregarded periods of overstaying under paragraph 39E as unlawful for the long residence. This is beneficial to people applying under other routes like the skilled worker route ...

Long Residence and 2023 changes to Immigration Bail

Hello, I have a question regarding the two changes to Long Residence route made in 2023. According to the changes that took place in April 2023 7.68 A person who has spent a period of time on immigration bail or as a visitor (or other temporary permission) who is later granted permission on another ...

Re: SET(LR) appeals?

So I decided to accept the 30 months LTR. After having spoken to a lawyer it seems I cannot accept Home Office's offer and still challenge it by initiating a PAP (based on the grounds that the length they are giving me is incorrect), as by accepting it there is no "refusal". Atleast that's what the ...
