Re: EEA Spouse FP application- better that they are 'pre-settled'?

When you say that we can apply for Pre-Settled Status together, is that true if I am not here on a Family Permit? Just on a Vistor/Tourist(?) visa? You do mention it at the bottom about this but it was about the RC. It is true that for the EEA residence card you can do it regardless of your current...

Re: Swedish citizen wanting to move to UK with American husband

I've entered with my US spouse as an EU National. We didn't carry any documents, but the Immigration Officer said that in order to let him in under EU treaty rights (we didn't want to go through the non-eea queue) she just asked some questions and then got him the stamp. I guess we were lucky, since...

Re: EEA 2 residence card applying online

What you’d be looking for is applying for the registration certificate and add your application to it: https://visas-immigration.service.gov.uk/product/eea-qp That’s what we did 6 months ago, right after moving to the UK. I certainly didn’t have PR back then. It looks like they’ve started editing th...

Re: EEA 2 residence card applying online

You can apply online. Your partner can add you to their application. I highly recommend this route, as it is far more convenient.

In fact, you can also use the European passport return service if you like; meaning that you don’t have to send in the physical passport to the home office.

Re: EU citizen with Canadian wife - waiting for residency card, left country for Xmas, will she have issues getting back

Hoi! She should be fine stating that she’s joining you if she takes along the documents you mention (marriage certificate, your pay slips, maybe a council tax bill/utility bill with her name on it too?). Ideally she would also have her certificate of application with her. I don’t know if you’ve alre...

Re: EEA (FM) - Question about payslips

Yes, we used the EU passport service and got the COA with right to work after two weeks, and the residency card and application certificate after 4-5 weeks from the application. I did send in additional pay slips and bank statements showing receipt of payment as they were made available to me. I quo...

If you are married and your EU partner is excercising treaty rights, you can go straight to the EEA:FM residency card.

Re: EEA (FM) - Question about payslips

You only need three payslips if you’ve both been there for more than three months. If your wife has only excercised her treaty rights for 2 months; they you should provide proof of those two months. I believe in the documentation requirement they specify that if you’ve been here less than three mont...

Re: American applying for EFM EEA Family Permit

Definitely go for the residency card application. It will be much simpler and there’s no need to leave the country. Once you have the certificate of application you should be all set and are allowed to stay until a decision is made. But if you send your application in now, you’re all set since your ...

Re: Stamp 1A Code

I would make sure it’s a certified translation. You’d need it to apply for your residence card regardless, so there’s no harm in having it done early. This is the route me and my husband took, but I feel they didn’t mind too much as his country of origin doesn’t require a visa to enter the U.K. anyw...

Re: EEA Dependant Ink Stamp - Right to work?

His right to work is automatic, so yes ‘technically’ he is allowed to work. You won’t find employers willing to hire him, though. Apply for the residency card ASAP, and within a month you should have a certificate of application confirming right to work. This will be sufficient for employers. Also D...

Re: Do I need registration certificate to be a sponsor

No, you don’t need it. You will provide documentation showing you’re a qualifying person. That’s enough.

You could apply for it at the same time and use the European passport service if you don’t mind spending more money but keeping your passports with you.

Re: Applying for residence card after 6 months FM

My husband registered with our GP without any type of visa a few months ago, not even family permit. They didn’t ask.

And you have the right to work, but it will be difficult to convince employers thereof. Just apply as soon as you’re in the U.K. and have documents that prove your residency there.

Re: Applying for residence card after 6 months FM

You probably want to make sure you have some proof of address.

If you can get your name on some of the utility bills already, and register for a GP, and you already have proof that your EU family member is exercising treaty rights, then you can just apply as soon as you arrive.

Once you return to the U.K. as a married couple, you can simply state that you are exercising treaty rights as an EEA national and would like your spouse to join you. You might have to show documentation proving this (your newly issued marriage certificate and perhaps some photos dating a bit furthe...

Re: How and where to translate marriage certificate?

This is what the UK Government has to say about it: https://www.gov.uk/certifying-a-document

I don't think the British Consulate will translate it for you, but you could get any professional translator to make such a certified statement, I imagine.

Re: UK Residence Card for Non Eu Spouse

You could do some of the following: Add your name to some the utility bills (they can usually add your name to the bill if you ask). Request forms to apply for a drivers licence: This will get you more letters addressed to you at the address. Register with a GP to get an NHS letter in your name at y...

Re: EEA Dependent Ink Stamp for NO TIME LIMIT?

Our story is quite anti-climactic, I suppose. In part due to my husband being a US citizen and the fact that he could have entered under a tourist Visa, and because he already held an Article 10 residency card from Spain. However, since the EU citizen line was much shorter, and we didn't feel like f...

Re: EEA Dependent Ink Stamp for NO TIME LIMIT?

Hola Rocio, I do not believe he needs to be a qualifying person, as you’re asking for right of entry, not right of residency. If you wanted to stay beyond 3 months, he would need to be a qualifying person. Me and my husband travelled in and he received this stamp while I was very clear that I did no...

Re: American with criminal history EEA FP

The easiest would be if you were accompanied by your spouse when re-entering. But having documentation that proves that you're entering to join your husband, who is exercising treaty rights, is also possible. If you'd like to keep your passport while the application for the residency card is ongoing...
