I am wondering if any Non EU spouses managed to get a schengen visa while they are waiting for the EEA2 in the UK and their passport doesn't have a valid proof of residence.... No they can't refuse it on that basis. EEAFPs are not regulated by the UK Immigration Rules.

What (exactly) did they put in the refusal notice?

If you are taking the Eurostar from London, you will pass through French immigration at London St Pancras before boarding the train - so you will have a problem as that is the point at which they will stamp your passport.

Depends on the adjustments of Schengen Regulations I expect.

The UK have already (and typically) stated that (re)entry to the UK for those with the new card will require ID card *and* passport presented together.

No. All EEA citizens have residence rights up to 3 months without the need to prove exercise of Treaty Rights - consequently so do their family members.

Always keen to learn - where are the 4 months coming from? I recall reading guidance on the old IND site (which I cannot locate now) that quoted 6 months, so 4 is a best guess, seeing as the minimum the BIA is likely to accept would be a month over the period during which you don't need to exercise...

Yes there is a slight risk they may not let you in. A wrong number is more serious than a misspelt name.

At the least you should try and get a letter or fax from the embassy stating what they told you about it "being alright" and take that with you.

Yes, you can get an EEAFP and it will be free - BUT as you are applying from outside the EEA/EU you will need to meet the requirements of the UK Immigration Rules to get it.

So, maybe your next EU-holidays will involve an official "complete move", including the paperwork.
