He doesn't have to go to his own country to apply for his country's passport unless no consulate/embassy services of his country in the UK. as the passport is expired and got the copy could go and apply for one to his consular/embays office declaring his intention. Then use it to register office.

Thanks for clarification, I also did ask as others were saying if do hold Bachelor degree taught in the UK, or have done GCSE in the UK and passed etc you might get exempted. I didn't think so but needed to clear my doubts.

Now that your partner got divorce certificate is there anything stopping you from getting married? as you will become direct family member of EU member with more rights. Unmarried cases could also go well as long as you have provided 2 years evidence of your relationship.

They do ask those questions am afraid if travelling alone, even if you go settled status(Non EU) -where is your wife. ?? those questions got asked recently(3 weeks ago) at Manchester Airport. The Authority can only do that if there is evidence of concealed substances or narcotic substances or criminal offences, have you been detained? It is a consent issue, nothing to do with Migration. All you have to do is to get your other half to go to notary office and give consent to travel with your child. have you got a dual nationality? - That is scary . I guess every one should apply for pre or settled status before travelling abroad, or DCPR. Try see if you can apply one of these while you there.
