Re: MN1 Child born in the UK

When was the child born? before your ILR or after your ILR? I assume the OP is Polish and so they are granted PR and not ILR. ILR is granted to non-EU citizens only. If the child was born to a settled mother or father AFTER they became settled, then the child is British at birth. Apply for British ...

Re: Unsuccessful applications

The issue with rpaw 's case has less to do with naturalisation law and more with the EEA Regulations. When you arrived in May 2006 and registered with WRS, did you change jobs within 12 months. yes I am not au fait with the WRS side of things, but I think that if you changed jobs within 12 months, ...

Re: Request a DCPR date changed.

You could have sent evidence of treaty rights and provide proof of when PR was acquired as opposed to when the card was issued. When faced with a similar citizenship refusal in the past, a Pre Action protocol and a threat of JR resolved the matter for the subject. Hi Obie, am awaiting EEA applicati...

I appreciate Obie & secret.simon for suggestions and comments. Just to clarify what PAP, OP and GLD means plz
PAP - Pre Action Protocol - there is a fairly specific format for this.

OP - Original Poster, ie you

GLR - Government Legal Department

Re: BC refusal, no 12mths PR

no, a reconsideration just looks at your application to ensure the home office followed procedure. You should have submitted your evidence with your PR application. The home office guidance states: We will not reconsider on grounds of: • long residence, where the statutory requirements are not met ...

Re: BC refusal, no 12mths PR

According to refusal letter:

Secretary of State has considered waiving failure to meet this but cannot find sufficient ground to do so,

but I have provided last 7 year's residency proof(employment letter and P60s)
Is this a good ground for reconsideration?

BC refusal, no 12mths PR

I have recently applied for BN and my application been refused on the basis that I do not have a 12 months permanent residency. I'm EEU citizen and have been leaving in the UK for over 13 years. My understanding was wrong,(PR status from 06.04.2018, NA application 09.11.2018) though I am able to app...

Re: Unsuccessful applications

What date is it stated on the letter that came with your PR card related to the date you have acquired Permanent Residence? If the letter says Sept 2018 then you must wait 12 months after. If the date states different then you need to wait 12 months from the date. Check the date on the letter not t...

Re: Refused citizenship.....very confusing, please help

P'60's, Council tax letters, tax credit letters. We threw in whatever we had just for peace of mind really! We've got evidence dating back years. Totally understand the point now that we couldnt apply immediately but it does say of he had only been here 5 years then you have to wait for another 12 ...
