My solicitor keeps saying as per current rules, I should have submitted my new visa application within 28 days of 13 May 2016, hence I reposted the question.

Even though his visa was granted on 24 March 2009, he only received it in the first week of May 2009 and arrived the UK on 13 May 2009. Can he apply any time after...
