That would be a loophole. You are misinterpreting the the issue here. A non-EU national can indeed apply without their EU national family member applying. EU Settlement Scheme Non-EU PR Application Submitted: 23-01-19 E-mail Received: 29 January 2019 I have submitted my proof of relationship as this website asked everyone to upload it but now I have a feeling that I shouldn't have done it as it's not required by law.
