Re: Shoplifting charge in UK store

You have put yourself in a bit of a predicament. You are lucky that you didn’t walk away with a criminal record which would have almost certainly impacted your immigration status. Whilst everyone can make mistakes and there is no reason to speculate what led up to this, as an I immigrant you have to...

Mistake after mistake by home office

My wife's EUSS family permit to join me in returning to the UK was rejected as the decision maker overlooked key pieces of evidence that was exactly in line with the guidance notes. On making a complaint my wife received an email informing her that the decision was overturned and to return to the vi...

Re: EUSS Family Permit

Does anyone know if you can reapply with further evidence at the same time as pursuing an appeal via first teir tribunal under the EUSS family permit? And whether or not the EUSS family permit will close on the same date as the EUSS in April 2022?

EUSS Family Permit

My wife has recently applied for an EUSS family permit for my wife to join me in the UK. This application was rejected on the basis that although I demonstrated for three years that I had been employed in the republic of Ireland, I failed to provide enough evidence that I was employed for the three ...

Re: Surinder Singh... To Risky?

If I were to act as as a sponsor for my wife, and apply for a standard join family visa. Can meeting the financial thresholds be on the basis of employment history meeting the eligibility criteria and holding current job outside the country that meets the thresholds, or will I have to move to the UK...

Re: Surinder Singh... To Risky?

Thank you for your response littlerr. As far as I am aware my wife has until March 2022 to apply under "EU Settlement Scheme family permit: join a British citizen" to return with me to the UK under Surinder Singh, that the deadline has only passed for defacto partners and extended family members. Is...

Re: Surinder Singh... To Risky?

I am aware that the 2019 case of ZA has ruled the center of life test to be unlawful, and "has no basis in EU law". Does anyone know if caseworker guidance has been updated to reflect this or are applications still rejected on this basis?

Surinder Singh... To Risky?

Please forgive the long post but I hope someone with more experience with UK immigration might be able to shed some light as to whether we stand any chance with a Surinder Sigh application to return to the UK with my non EU Spouse. I am from the UK and I am married to a Cambodian Citizen. I knew my ...

Re: EEA(FP) application pending - meanwhile moving to india

The information you were given is incorrect. You have until April 2021 to return to the UK via Surinder Singh. You need to be either living together in the EU or UK at the time you apply. If her Visa is expiring you should be able to obtain an residency entitlement extension under your EU Directive ...

Visa requirements traveling post Brexit - Non EU national (British Spouse)

Does anyone know if a non EU national married to a British Citizen currently living in the ROI on an EUTR stamp 4 will require a VISA to visit Europe or the UK after the transition period ends?

Re: Surinder Singh is it too late to start?

I'm no lawyer either, but my current interpretation of this that EU treaty rights are still valid, certainly countries are still processing EUTR applications, but no one knows exactly how they will be respected by the UK and other EU countries post departure. Countries may set the benchmark to remai...

Re: Surinder Singh is it too late to start?

Whilst the UK is going through the transition period you technically enjoy the same rights as you did when you were an EU citizen, this means that it *should* still technically be possible obtain an EU treaty right visa as applications are supposed to be processed within 6 weeks. Home office guidanc...

Re: Irish Visa Application Rejected

It turned out they had made a mistake, after 5 emails to ask them what they were asking for the original decision maker finally responded by saying that they need the marriage certificate to be certified in the Ministry of Foreign Affairs in Hong Kong.

Re: Irish Visa Application Rejected

Why would the Cambodian Ministry need to legalise a Hong Kong document. Doesn’t a cetificate of no impediment provide enough to prove my wife was not already married. Because Cambodia is not part of Hague Convention. They need to satisfy that one of their citizen is in a marriage that is recognised...

Re: Irish Visa Application Rejected

To me that makes no sense. If the Cambodian Ministry of Foreign Affairs (which are not stationed in Hong Kong Consulate) are just legalising the document then they are not acknowledging the validity of the document and it is therefore not possible that it provides the evidence that the VISA office a...

Re: Irish Visa Application Rejected

But Hong Kong is party to The Hague Convention and the document was issued by a government department. It should not require legalisation as far as my understanding as it should already legally be considered valid. Why would the Cambodian Ministry need to legalise a Hong Kong document. Doesn’t a cet...

Re: Irish Visa Application Rejected

Thanks very much for the insight. In regards to having my marriage certificate certified in the host country? being able to achieve this is practically impossible. What I can do is provide a certificate of no impediment from just a few weeks before we got married. That should be sufficient proof tha...
