Your first visa approval date is irrelevant. As I said, it is from the date the caseworker looks at your application to decide your ILR application and so counts 5 years backwards. It counts from the date of decision and backwards. If in any 365 day period, you had more than 180 days of absence, you cannot get ILR Thanks Zimba for your reply. You mean it's counted backwards from date of decision upto the date of first visa approval? My maximum absence was at the start after getting the Visa in 2019, after that no absence for 4 years. So if it's counted backwards from 14.06.2024, I would not have more than 180 days absence in any rolling ...

But it does not affect the continuous period because he effectively has applied within 14 days of when the 3C protection ends (which is when the AR process ends). For eg. If CoS start date is 15th Sept 2022 but SW visa is approved say by 20th August (person already in UK on T1E), can the employee start working from 1st September if employer agrees or he can only start from 15th Sept as per CoS start date?

Also, to add what if the Admin Review is refused, do you still get 14 days from AR refusal to apply another visa without being a overstayer or breaking your 5 years ILR count?
