Looking at "Utlänningsförordning (2006:97)" laying down the Swedish laws for immigration you should have no problems at all. In chapter 4 see §9 5th which is how your wife got her residence card and §12 4 for your requirements. Google translated so not the best but it is pretty accurate... http:...

We are back! We turned up an hour earlier at Stansted in case of any arguing about visas. The check in lady knew what the stamped meant and didn’t ask any questions. Arrival in Spain and it’s the old bold man in the passport booth! He sees the residence stamp, flicks through the rest of the pass...

Thanks for the support A copy of the MRAX case is now printed and ready as well. I'll do my best to document as much as possible. I deleted everything off my answer machine so I can call home and record any conversation, try to erase that from Spain. I also got 2 SD cards so I'll keep the swap card ...

http://www.ambafrance-uk.org/Family-mem ... opean.html Explains why she needs a visa to visit France. It is however free of charge and they release new appointments at the embassy between 3pm and 5pm on Thursdays so you might be able to get one today.

Call me stupid but its time for a holiday and we are thinking Spain again (if it wasn't for the fact that we have family there we never ever bother with them again). My wife's Schegen visa has now expired so we are going to have to try the EEA family route again. We will go to the same airport in Va...

Thank you for the link!

Minor update Even though it is not directly relevant to our case anymore as I am only an imaginary husband inside the mind of my wife but my complaint about Spain excluding UK residence cards under 2004/38/EC might be moving on. The EU ombudsman sent me a copy of a letter he has sent to the presiden...

The Swedes has a funny one. http://www.swedenabroad.com/Page____54849.aspx There is no visa fee for EU/EEA-spouses and their children (under 21), registered partners and co-habiting partners of EU/EEA nationals (does not apply for co-habiting partners of Swiss citizens). The original Marriage Certif...

I missed this part the first time around: Practical Handbook for Border Guards (Schengen Handbook) 6.3.2. If a person enjoying the Community right of free movement does not have the necessary travel documents or, if required, the necessary visas, the Member State concerned must, before turning him/h...

The results are in… The bold man was correct, I do not exist and therefore my wife (who isn’t married to me anyway) needs a Schengen visa before travelling. As she didn’t have a visa they were right in deporting her.

For members of the household of the Union citizen, these guidelines cause confusion to an area of the Directive which is already quite clear. Why? I think thats just the memo being wrong and not the actual guidelines. When can a member of the household be considered "dependent"? Surley it was suppo...

Transfer to join

I know a non EEA citizen can get a free Schengen visa if he/she is travelling with or joining his/hers EEA family member. How about transfer to join? Say for example that my wife was to travel alone from Bolivia to join me in the UK with a transfer in Spain. Being a Schengen national she needs a tra...

The lawyer is paid through legal help in Spain, so even if we loose we have at least spent some of their money :). We might be able to ask for flight tickets etc later on if we win but it is more important to put things right again and maybe even to get them to change RD240/2007 to reflect the direc...

Small update. We have had the hearing. One would have thought that by now they would have figured out that we will not go away and admit their wrong doing. We have not even asked for the flight tickets back or any other damages. The only thing we have asked for is to have the deportation decision re...

Long time and no update!

Solvit gave up in the end, what can they do when one party isn’t the slightest interested in solving the problem? My EU petition ended up with a “yeah, that seems to be in breach of the directive but we can’t be arsed to do anything about itâ€

I’ve been fine, thank you. Been busy changing jobs etc (still stuck on the twilight islands though). I saw your post about the petition but at least they are having a proper look at it so hopefully something good will come out of it (around 2025?). After several rounds with the commission and the ...

Thank you for the answer, The embassy will not issue a new passport unless she shows them a police report showing it as lost or stolen. If she reports the passport as lost to the police and then gets a new one from the Embassy (it took my wife 2 months last time so unlikely that she can get one in t...

How do you get the passport back?

I have a friend of a friend with a problem that I thought maybe the nice people here could help out with ;) She is a Bolivian national married to a British. She has a 12 year old son from a previous marriage; the father is no longer alive. The son has been living for a few years at a friend’s hous...
