Re: 10 year ILR: Discretion on absences

There is no gap, I am sure of that. I won't post personally identifying information, but the rough timeline is: Tier 4 visa until late June 2019 October 2018 applied for EEA RC, granted November 2018 April 2019 applied for pre-settled status, granted early June 2019 I am only curious if the tier 4 v...

Re: 10 year ILR: Discretion on absences

When did you previous visa expire and when did you get an RC as an unmarried partner or Pre Settled status?? My previous visa expired or would have expired only a few weeks ago, around the same time I was granted pre-settled status. Not sure if that counts though, or if the visa automatically got c...

Re: 10 year ILR: Discretion on absences

Oh, right, are the rules here different? Because time as an EEA family member technically also counts as a discretion by the home secretary here, right? Huh. Thank you for pointing that out, that hadn't occurred to us. This should be okay though. Plus, I imagine pre-settled status doesn't require th...

Re: 10 year ILR: Discretion on absences

Ah, right. No, unfortunately settled status really is four years away for me, we already double checked that. My partner has had permanent residence for several years and a DCPR. So as far as I understand the qualified person criteria per se don't apply anymore, she just has to make sure she maintai...

Re: 10 year ILR: Discretion on absences

Unmarried partners, living together for about 3 years now. Does that make any difference though? I thought 10yr ILR was independent of my sponsor.

Re: 10 year ILR: Discretion on absences

Thank you! I thought so too. Are there any cases of successful applications with discretion? The one long trip was 150 days. Without it, I am just below the 540 day limit. No absences of over 180 days. Ah, yes, I don't know specifically about the 5 year routes as they don't apply to me, I just vague...

10 year ILR: Discretion on absences

Hi all, I am in the process of preparing for a possible 10-year ILR / SET(LR) / long-residence ILR application, but have a few too many absences. Has anyone here had success with excess absences and discretion on that? All the posts I've found on the topic were from rejected applications, but I'm su...

Re: Lounes case, pre-settlement

It's after the application that the HO discovered that I am British too. For that reason, they then rejected the original application and sent the papers for Lounes. So, hypothetically, suppose an online/app application in a Lounes case DID go through and was granted pre-settled status. Would this ...

Re: Lounes case, pre-settlement

But we were never even asked in the online application if my sponsor has dual citizenship. It asked about her nationality, but it wouldn't even let us select more than one. So we just put her EU nationality as that's what's relevant here. At no point did the online application ask us about any furth...

Re: Lounes case, pre-settlement

For those that tried applying online, where exactly did the online system not let you proceed? We did it online / through the app, and I am 99% sure we were never even asked if the sponsor has more than one nationality.
