Re: ILR Application: Over-18 Dependent

Apply at PEO with parents and fill application as per facts. Take educational documents with you to cover the period of study.
You ll get ILR without raising of any eyebrow by the case worker.

I doubt that so many have done that and it worked.
No doubt one can revise return but it is costly and un-safe.

ILR - Walk in same day service at PEO

Here is an interesting example wroth sharing. An applicant was planning postal application but his dear one died back home and he wanted to go back to home country as soon as possible and that too with ILR at hand. So he searched for appointment for same day service and none was available before his...

It is very strange that your application is pending with UKBA for over six months.
In Pakistan such applications are decided by BHC within seven working days.
So it would be better to re-apply in Pakistan if you are going there after withdrawing your application.

A UKBA circular issued to legal representatives states that their client can make payment through bank draft.

So it was usual mal-adminstration and this time on the part of UKBA payment counter staff.

Congratulations to you and good news for others who have job related absences of more than 3 months at a time. But there is no consistancy of treatment at the Croydon PEO. In your case 123 job related absences at a time have been disregarded whereas case of santoshganpath was refused on 115 absences.

Are you asking about your partner only or your passport has also been sent to UKBA ?

There are four aspects relevant to this discussion/topic: 1. Immigration Rules- The relevant rules requires spending 5 years continuous law full period in UK for ILR and in rules neither there is any mention of absences nor of any discretion thereof. UKBA/Tribunal is bound by what is said in immigra...

Today UKBA has issued new version of IDI Chapter 6A Settlement Tier 1. I had pointed out a mistake by which "para 5.1" was mentioned instead of "para 2.1". UKBA has corrected the typing mistake which makes it clear that 180 days absences mentioned in para 2.1 are apart from job r...

Lately there are instances that even job related absences exceeding 90 days at a time were not disregarded what to say of private absences. But I expect that by the time you would apply for ILR in Feb.2012 the UKBA would streamline the use of discretion by their staff and you would be OK on producin...

From 4 Oct 2011 till date it is too much time to issue a formal refusal letter as no other issue was involved. Consider sending a politely worded complaint through post (instead of email) regarding the standard of service at PEO - by using the form provided by UKBA. http://www.ukba.homeoffice.gov.uk...

Instead of paying premium fee for FLR Tier 1 (HSMP) as well as fee of solicitor it would be better to send postal application. Postal FLR Tier 1 (HSMP) is normally decided within 4 weeks. PEO staff is not well versed with FLR Tier 1(HSMP) as now such cases are very rare at PEO. In addition send reco...

If you applied for Tier 1 in India in June 2009 under Para 44 of HSMP JR Policy Document of 2008 than all the period between two leave spent in India would be treated as leave towards ILR as per Para 50(b). Hence you have continuous stay in UK for ILR in 2012.
One should give complete facts.
