Lol! The 'Official' Naturalisation thread appears dead. I have to come here for any useful information. It is interesting to note this 'Satyagraha' response to the "cleaning up" of the other one- intentional or not.

Sounds a lot like common sense really. We could have told them that Residence Permits only have a declaratory effect and does not confer any rights in itself.

How does an unemployed person get enough cash to take such a case to such great extends?

Re: A Request

I did not see even an iota of anything offensive, disheartening or anyth similar to what the others described. No need to become defensive mate, the other guys are rephrasing and repeating what you are saying but try to argue, while agreeing with everything you said. If I were to appear in front of...

There are statistics that have been collected to back up what I said about the Home Office appearances at Tribunals and the % of appeals that are won when represented, unrepresented and paper only , so it's not speculation by me; you can search for them if you like, but it's not crucial to this thr...

Re: Proof

Don't worry; my comment is not specifically about your case or any other case. My comment is about the fact that the Home Office does not turn up for Asylum and Immigration Tribunals on quite a regular basis. If the EEA Directive appellant successfully proves their case or unsuccessfully fails to p...

Ah, so you meant 'living' instead of 'leaving' in your original post. Expelling on the basis of 'Public Policy' means that, in case your cousin turns out to be the next Jack the Ripper, they get dibs on which flight to send her back to her country of nationality on. Re: the MN1 form, it's best asked...

Re: CASE

The Home Office don't need to turn up to win; it is up to the appellant to prove their case. If the Home Office are the respondent , then the Home Office do not need to prove anything. If the EEA appellant fails to prove their case the Home Office win anyway. Huh? Why would you say that? As you ear...

Thanks for your update. Here is your earlier post. She wants to get married in 3 months time-do you think that's ok as she just got her PR status. I would agree that the current method for approval might exactly follow the pattern that you have suggested- take it case by case and if some difficult caseworker refused the application and an appeal was made, a Senior caseworker would approve it. But, that by its very nature, creates inconsistenci...

The problem with asking for a SPECIFIC company whose insurance WILL be accepted by the UKBA is that, as remarked by the Lord Sedley, such an insurance may not exist. P.S- FYI, for the nationality application that we made, we used a health insurance from Spain (untranslated) and still got approved. H...

http://www.bailii.org/ew/cases/EWCA/Civ/2006/1494.html Hi Mr. thin ice, check out Lord Justice Sedley's opinion on the matter in this case- As it happens, the child now has health insurance. But I would enter a caveat as to whether the Directive, when it speaks of "sickness insurance in respect of ...

Now, I do not see how the 6 month rule will not be broken if your EEA family member will be out of the UK for 4 days out of the week. Technically, I assume it will be possible. Because the day he leaves and the day he returns will not be counted. Which means, assuming he leaves on Monday and returns...

The premium service in Liverpool is protracted to cost 300 pounds WHEN it starts. As far as I know, no timeline has been given for its commencement. So currently, postal application for Residence Card using EEA2 seems to be the only way forward.

The nationality application is a lot easier. Since he already has the document certifying PR, he will not need to show the P60. However, some NCS may not be clearly tuned into that fact. So, I would advice you to ring all the NCSs near you and find one that knows what the proof of exercising treaty ...

Comprehensive Sickness Insurance may not need to be private?

http://www.bailii.org/ew/cases/EWCA/Civ/2006/1494.html I was looking at this case and found this:- But I would enter a caveat as to whether the Directive, when it speaks of "sickness insurance in respect of all risks" is necessarily speaking of private health insurance.
