In worst case scenario you can go for retained right to stay in the UK.
For such application you need to show marriage you were married since at least 3 years and you both have lived in the UK for one year.

Re: EU Settlement Scheme Family Permit for Dependant Parent granted. How to apply for pre-settle status ?

Hello. I have a few questions for you if you don't mind answering. We are trying to get my wife's recently widowed father over to the UK on a Settlement scheme family permit. Firstly, am I correct in thinking that he has to apply himself and not us? I also read that dependency will be assumed but o...

Thank you guys for all the answers;
How can I check if the permit which he's having is under Arcticle 10,and not under Romania law.
Thanks!
To get entry through land border he doesn't need article 10 card or article 20 card.

Re: EU Settlement for Parents of a Non EU Citizen (Asian) married to an EU Citizen

Your wife can apply eu settlement scheme family permit for your parents as her in laws which is quite straight forward. Hello All, I am a Sri Lankan married to an EU Citizen (Italian) came to UK under the EU Settlement Scheme. My Parents are fairly old (Mum 72 and Dad 78) and they are in Sri Lanka f...

Re: Criminal record and EU pre-settled and settled status

if your prison sentence is twelve months or more then you have to declare it otherwise not.
When you will apply online you will be asked about that and because you were given less than twelve months you don't have to tell home office about this criminal record.

He is not correct regarding Home office response.
HO will decide your application within two months.
Most of the applications are taking roughly two months.
I don't know why these moderators try to disappoint the people who are waiting for their decisions from Home office.

Re: EU settlement - Non EU family member - CoA and decision time

Hi iwolga You are completely wrong regarding extended family members of EU citizens. To be eligible to apply to EU settlement scheme as an extended family member one doesn't need to be RC holder. Extended family members with EU family permit can apply in this scheme. I know some applicants who appli...

Re: EU settlement scheme family permit for mother in law

You can send any documentary proof to HO which can be helpful in your parents applications included any remittances sent to them. If they are granted eu settlement scheme family permit in their country of origin and they come to UK they will be able to apply for pre settlement straight away.

That is true. In this type of applications dependency is assumed. You don't need to provide proof of financial support.

in this particular case, your EU spouse will be sponsor of her/his in laws (your parents). Your parents can apply for eu settlement scheme family permit straight away ,they don't need to wait for your settled status outcome.

Re: EEA Family permit refused for mother-in-law

Apply EU settlement Family permit instead of eye family permit.
In eu settlement scheme dependency is assumed and home office cant ask for proof of dependency.parents and in laws are considered to be close family members.

If your father is EU national then your brothers should apply EU settlement Family as close family members.
If you are sponsor then I am afraid they won't be able to apply under this scheme.

It's indeed a bit late.
Most of the applications now a days are taking 60 to 70 days.
You should contact resolution centre and ask for escalation.
Sometimes applications are stuck due I.T issues.
Are you non EU family member of EU citizen?

Apply online and book appointment for biometrics after submitting application. Your father does not need to send any document to Home office. UKVCAS will scan passport ,take photographs, fingerprints and signatures. He will receive CoA after biometrics and hopefully will get settled status in two mon...
