You can both receive pre-settled status, it will expire in 5 years if visits are made occasionally

The lawyer was right, you can apply before, but the Home Office says such applications would take more time. Considering the current time is about 8 weeks, it's not much surprising your application wasn't considered.

Have they returned your passport?

That's because a pre-settled status is not linked to anyone else but you. However, you remain in the UK after it expired, you will need to receive a settled status based on the ROR.

If that application to remove an overstay record was made and it will be successful, you shouldn't get questioned at the border anymore. But you will still need to declare it in further visa applications if asked specifically. Thanks for your reply. So I guess I shouldn't worry about my application...

You will then have to apply for further pre settled status until you are able to get 5 years continuous residence. Okay thanks, I thought I get pre-settled status once and never more. That's what the guy on the phone said when I called EU Settlement Scheme. but he sounded confused himself about it....

You can apply as a family member until the divorce is finalisd. However, if your spouse doesn't have any sort of indefinite/permanent residence as an EU citizen, you should provide evidince of their continuing residence. Evidence can include bank statement, NI number if they paid taxes, etc.

In any case, you can apply for the Settlement scheme and probably get a pre-settled status for five years right now. The only thing you would need from them is your spouse's application number/code if they have already applied to the Settlement scheme. After this and upon finalising the divorce proc...

you will need evidence of your spouse's exercise of treaty right prior and up to the point of the divorce being finalised.
