No pre settled status is linked to the EEA national. In the event of a breakdown of relationship, it could be curtailed.

That's because a pre-settled status is not linked to anyone else but you. However, you remain in the UK after it expired, you will need to receive a settled status based on the ROR.

You can apply as a family member until the divorce is finalisd. However, if your spouse doesn't have any sort of indefinite/permanent residence as an EU citizen, you should provide evidince of their continuing residence. Evidence can include bank statement, NI number if they paid taxes, etc.
