You have to apply from your country of residence. If it was that simple everybody would be going to US to apply as they only take like 10 or so days

If they separate his visa will become invalid and he will have to return to his country of origin nor will he be able to get his ILR as he won't meet the requirements for that.

Has he tried reporting the abuse to the police?

The applicant needs to provide the actual passport so that the visa can be entered into it. The sponsor can provide a certified copy.
