Re: Can HO check dates out of UK on their system?

Thanks CR001, very helpful.

I take it that every passport page (including blank pages) are still required for scan? Or will only pages with stamps suffice?

Can HO check dates out of UK on their system?

For Set(LR) 10 years long residence, you need to prove you've not been out of the UK for (as I understand) more than 548 days across 10 years - averaging 7.8 weeks a year. Is it the case that the HO will trawl through faded stamps in various passports to prove all the in/out dates? Or do applicants ...

Re: Replacement biometric residence permit (BRP) visa

Perhaps if your wife’s BRP card is stuck with customs in India and she needs to return to the UK before her current spouse visa expires on 22 April 23, one option could be to report the BRP as lost and apply for a Replacement BRP visa which lets her re-enter the UK once only. It costs £154. Once she...

Re: Your experiences with applying for NRPF change of conditions?

Thanks for your reply Higgs. Yes, he pays me at the level the CMS calculator says. And I pay the mortgage (albeit from money he sends me) as he has his own place. I hope to take over the FMH one day when I'm earning more.

Re: Your experiences with applying for NRPF change of conditions?

Thanks JB007 for that, interesting reading. I'm on 16 hours as my employer won't give more, and the hours are unsociable. I noticed that UC states the claimant should work a "maximum" of 25 hours, rather than a "minimum". I'm on a Parent Visa, but in a few months, will have been a UK resident for 10...

Your experiences with applying for NRPF change of conditions?

Has anyone tried applying for NRPF to be lifted? https://www.gov.uk/government/publications/application-for-change-of-conditions-of-leave-to-allow-access-to-public-funds-if-your-circumstances-change I wondered: -How hard is it to make the application? -How tight are they, in deciding applications? -...

How long does it take for a decision for NRPF change?

I'm curious - has anyone applied for NRPF removal? If so, how long did it take for them to get a decision back to you? https://www.gov.uk/government/publications/application-for-change-of-conditions-of-leave-to-allow-access-to-public-funds-if-your-circumstances-change They don't state how long it ta...

Huge Black Hole Visa Delays ?!

 I'm sorry to rant on here... Is anyone else in the same position?! I can't be the only person waiting now into my 7th month to hear anything, anything at all, from the HO about my visa extension to remain in the UK? There's been absolutely nothing. No email/txt/letter to say that it would be...

Re: continuous residence reset if leaving the UK whilst awaiting a decision?

ok - thank you. When it is said, that an application is treated as withdrawn, if you leave the CTA... what happens if your application is accepted, whilst you are outside of the CTA, and your visa gets posted to your house? (And someone forwards it to you overseas?) The application itself has conclu...

Re: continuous residence reset if leaving the UK whilst awaiting a decision?

@vinny Thanks for finding that. The visa category would be Family, Parent of a child, further leave to remain. From what I read, although confusing, it sounds like it may be possible to leave the UK on 3C, make an application from abroad within 14 days, and if successful, re-enter and not have conti...

Re: continuous residence reset if leaving the UK whilst awaiting a decision?

The applicant hasn't left the UK yet (they are on 3C), but would consider leaving (for holiday to see family) if their continuous residence clock wasn't reset, if re-entering the UK on a new Visa. (applied for, from abroad) I would have thought a key point here, is that it's not the applicant's faul...

Re: continuous residence reset if leaving the UK whilst awaiting a decision?

Yes, their application will be withdrawn if leaving the UK whilst on 3C... but my point is if a subsequent application is made, whilst abroad, to re-enter the UK. If successful, does it mean the applicant's continuous residence clock is reset? Given that the applicant left the UK on lawful residence...

Re: To report breakdown of marriage or not?

I understand that they ideally would like you to inform them, only if the relationship has "permanently ended". If she applies for any other visa in the future to come into the UK, she'd have to actually prove that it had permanently ended too, either with divorce or steps towards it. Otherwise they...

continuous residence reset if leaving the UK whilst awaiting a decision?

If a person is awaiting an (overdue) decision from the HO to extend their stay (so applicant is on section 3C leave) and the applicant flies out of the UK for a holiday, reapplying for same visa once abroad - then if this new visa application is accepted and the person re-enters the UK, is their "co...

Re: Contacting UKVI for an application status update - your experiences

I can understand how, 'if capacity permits' could feel like a lottery however. It's like saying, there's a chance that capacity will permit. I really wish they would just be honest with how long average length of applications in different categories are taking. They must know these figures. It would...

Contacting UKVI for an application status update - your experiences

Just thought I would put my experience here, so others know what to expect. I have applied for an extension to remain in the UK (family visa). I have waited more than the 8 weeks which the HO say is standard processing time on their website. I have received no correspondence from them to say a decis...

8 weeks has passed - but no correspondence - Who to call?

I submitted a family visa application to extend my stay in the UK. Just over 8 weeks have elapsed since I submitted supporting documents and biometrics. There has been no correspondence since. The HO website says: If your application is straightforward, we will make a decision on it within the stand...

Re: I'm separated, is my husband still legally a 'spouse/partner'?

Thank you for your reply. What we have done, is attach an empty family declaration, where partner name says: not application - see cover note. There is then a cover note saying that we are not in a relationship nor do we intend to be in one, or live together, in the future. But that if the home offi...

Re: I'm separated, is my husband still legally a 'spouse/partner'?

Thanks for your reply. I have not informed the Home Office, as a consultation I had earlier with an immigration solicitor said that it was not necessary to inform them, because the separation was close to when I would apply for a visa as a Parent, rather than as a Partner. As part of my visa applica...

Re: I'm separated, is my husband still legally a 'spouse/partner'?

Thank you - however I'm still unclear about the following yes/no questions... a) Should my separated husband list his name as a "Partner" on the "family declaration" form labelled for spouses to complete? b) Should my separated husband tick the box to say he is my spouse and we live together? (We do...

Re: I'm separated, is my husband still legally a 'spouse/partner'?

Thank you for your reply, I have read that. But I'm still unclear.

In law, is my husband who I'm emotionally and physically separated from, still considered my spouse, if we are not yet divorced? If so, should he complete the "family declaration" document, entitled "for spouses"

Thank you

I'm separated, is my husband still legally a 'spouse/partner'?

I am applying for a Parent Visa, as I live separately from my husband and our relationship no longer subsists. We aren't legally separated, but we have each detailed our plans to divorce. However, after submitting the visa application, it says I must download the 'family declaration'. This form ("fo...

Re: Parent or Partner? Grey area decision?

Finances are still currently heavily tied though, due to NRPF. And no formal separation/financial paperwork. I assume ultimately the HO will decid...

Parent or Partner? Grey area decision?

What happens if you are applying to extend your leave in the UK, and its a grey area about whether your UK-born child's parent, is your partner or not? Given that: -you've resided with several extensions of leave in the UK up to now (based on partner and child) -you now live separately (with separat...
