Re: Can you lose workrights while stamp4 is in process

is it possible to apply for Stamp 4 in your 20th month of employment to account for the processing time, which is now over a month, by the Department of Justice? The contract is supposed to be 2 years at least to apply for CSEP and there are 12 months in a year - in ideal world, you apply for Stamp...

Re: Next Steps - Expired Residence Card - Settled Status or Citizenship?

Then you might be in trouble - if you don't have pre settled status, I'm not even sure if you're legally in the country (unless I misunderstood and you did apply for EUSS). You can't do it now as you're separated long ago. Why do you think your residence is legal right now? I'm not sure what's the b...

Re: Next Steps - Expired Residence Card - Settled Status or Citizenship?

Before 2020 (and now in EU member states, eg Ireland), you were supposed to apply for retained rights, be granted those (it's not an automatic process) and only then you could apply for permanent residence. If your relationship was broken down, you were supposed to inform the authorities and go thro...

Re: Join family D visa - what stamp number?

There's a lot of stuff that they have outside of public view. You might have to ask them about it directly if you want clarification.

Stamp 3 seems the most logical choice out of available stamps (besides Stamp 4) - Stamps 1 or 2 wouldn't exactly be applicable.

Re: ILR Depandent Visa or Citizenship?

I'm not sure if you can do either of these. Regarding visitor visa - how.will you prove that your daughter will return back to China (which is expected for a visitor visa) if this is not what you're planning? Regarding ILR dependent visa, children are following the status of least privileged parent,...

Re: Bringing wifes children to the UK

Why did it take a year to want children to arrive? Why didn't they apply with your spouse?

It's not easy to bring children to UK if father isn't going with them. Read https://freemovement.org.uk/sole-respon ... desirable/ , for example.

Re: ILR 28 days vs Application Date rules

But why would they use application date?

The fact that a person applied for a UK visa from overseas does not give them any basis for legal stay in UK until the visa is granted.

Also, different visas have different rules from when ILR period starts - what visa were you applying under?

Re: For how many days can I stay in Ireland if I resign while on CSEP Stamp 1 after completing 12 months?

Usually DETE cannot catch up with the redundancies, so most likely you can stay in the country until your current visa expires. If you can find a role AND get a CSEP before that is over, you can apply for a new IRP.

No. Either super priority or standard.

Re: Time in UK (Affected due to COVID)

Cretainly not from Nov 2020, as you were on a visitor visa.

IMO if you're unsure, go from the latest date, which is July 2021. Also, how would you prove that you were on a skilled worker visa in May 2021, if you only got a BRP in July?

What's the date on BRP itself?

People change to CSEPs from other visas in country rather often - the fact that you're in Ireland shouldn't necessarily hinder it.

There's no magic way. You can try to send them an email explaining the situation, but they're not obliged to give you one. My advice is to secure the appointment first, collect documentation later (although French appointments are a week ahead, so might be challenging to prepare, but there are other...

I don't know which EU country you're dealing with, but maybe call/email them (latter is preferred) explaining this? If they respond that you're okay, you can apply. Also you can't apply for a 2-year visa, really. Embassy decides for you. I got a 45 day visa after 3 year one (with a long gap, to be f...
