Hello Jami,
What about case like mine.
I have been out form UK at a streach 105 days. Out of which first 17 days were paid leave as I was on garden leave (made redundent). So my unpaid leave will be 88 days.
Will it be a break on continuty of 90 days?

In absence of any evidence to prove the "date of application", the decision rests on the information held on the UKBA systems. If UKBA records show the caseworker that you qualify for ILR after 4 years, then you should be issued a letter confirming grant of settlement on a date in the past. Persona...

If you have already completed 5 years in the relevant qualifying category, why don't you apply for ILR at PEO and tell them you need backdated letter to free you from Immigration Restriction year before. This way you wont risk wasting £1350 and will still avail the benefit of HSMP(JR). I wasn't su...

1. Did you apply for HSMP approval from within the UK or outside? 2. What method did you you use to send your HSMP application? And, please don't post queries in a (active) topic where the query is irrelevant to the stated subject of the topic. 1.I was in UK on student visa when I applied for HSMP....

Date of HSMP application (under JR) and ILR

Hi sushdmehta Please go to page 18 in "closed category ", which says if you have applied ON and before 3rd April 2006 then you will be eligible for ILR after 4 years. I was sure I have applied ON or BEFORE 3rd April 2006 because I have receipt from HO saying they received my application on 4th April...

For hsmpgafla answers to your questions: 1. Can I file appeal when I still have valid visa OR I can only file appeal when my valid visa is expired? ans= if you have still leave left - no right of appeal would be given in refusal letter 2. If I go PEO and use premium service now and if my visa rejec...

Given that you applied in 2005 (before the qualifying residential period was increased to 5 years on 03-Apr-06), you may apply for settlement after completing 4 years in the UK. Given your circumstances (appeal, delayed entry), a precise explanation of facts in a cover letter (if applying by post) ...

Submit SAR. You can ask for your initial HSMP application form - the copy will have the date stamped. The problem is that when application is sent by courier, the date that it is received at UKBA is considered as the application date - and not the date of posting (handing it to courier, in this cas...

You're confusing continuity of residence in the UK with physical presence in the UK. From an ILR perspective, both aren't necessarily the same. Anyhow, you now know what questions may be put to you if the caseworker believes that in your case continuity of residence in the UK is broken. So be prepa...

I think in my case its 89 days not 90 days as my employment ended on 21 dec 2008 not on 21 November 2008. Am I right? Also I got my final salary on 24th dec 2008. BTW Thankyou for PM. Re: ILR-eligible in 4 or 5 years

I have a question regarding the JR for the ILR. It writes "on the basis of an application submitted between 3 April 2006 and 7 November 2006", you will still need to fulfill 5 years of residency. What does this actually mean? Does application submitted means the date when u got your HSMP approval l...
